    Extractions: The Impeachment of Andrew Johnson »Name: Salmon Portland Chase back to Who Was Who S In one of his first acts as Chief Justice, Chase appointed John Rock as the first African-American attorney to argue cases before the Supreme Court. In March 1868, Chase presided over the removal trial of the impeached President Johnson in the U.S. Senate. The Chief Justice brought to the trial a much needed air of dignity and impartiality. As the first impeachment trial of a President under the Constitution, Chase realized that the procedure would set important precedents. He insisted that the Senate conduct itself as a court of law, not as a legislative body. Chase was unable to forge a solid majority during his tenure as Chief Justice and often found himself in dissent on such important cases as Ex parte Milligan (1866), Bradwell v. Illinois (1873) and the Slaughterhouse Cases (1873). In Texas v. White (1869), however, he authored the majority opinion that ruled secession unconstitutional and reaffirmed the Congressional right to guarantee republican government in the states. This decision essentially endorsed Congressional control over the Reconstruction process.

Born to a poor family in Raleigh, North Carolina, as a boy Johnson never attended school. He was apprenticed to a tailor but ran away at age 16 and later settled in Greeneville, Tennessee, where he eventually set up his own prosperous tailor shop. He married Eliza McCardle, the daughter of a shoemaker, who helped him improve his reading, writing and math. They had five children. Johnson discovered a flair for public speaking and entered politics, championing local farmers and small merchants against the wealthy land owners. He enjoyed a rapid rise, serving as a mayor, congressman, governor, and senator. Although he was a slave holder, he remained loyal to the Union and refused to resign as the U.S. Senator from Tennessee when the state seceded at the outbreak of the Civil War, which brought him to the attention of President Lincoln. ADVERTISEMENT In 1862, Lincoln appointed him military governor of Tennessee. In an effort to win votes from Democrats, Lincoln (a Republican) chose Johnson (a War Democrat) as his running mate in 1864 and they swept to victory in the presidential election.

Impeachment involves accusing an official and the trial that follows the accusations. Once a trial is conducted, it must result in acquittal or a guilty verdict. Impeachment is most commonly used to remove federal judges from office, but only two Presidents, Andrew Johnson and Bill Clinton have been impeached and gone to trial. President Richard Nixon resigned after the Judiciary Committee of the House of Representatives brought three articles of impeachment against him. He resigned because conviction in the Senate was guaranteed. The terms of impeachment in the U.S. are detailed in the U.S. Constitution, Article I, Section 3, which states, "The Senate shall have the sole power to try all impeachments. When sitting for that purpose, they shall be on oath or affirmation. When the President of the United States is tried, the Chief Justice shall preside: and no person shall be convicted without the concurrence of two-thirds of the members present" (Cigler and Loomis A-5). All three Presidents had impeachment charges brought against them based on the argument that they had violated Article II, Section 4, of the U.S. Constitution, "The President…shall be removed from office on impeachment for, and on conviction of, treason, bribery, or other high crimes or misdemeanors" (Cigler et. al A-9).
