    Extractions: Government Structure Vietnam Table of Contents Despite its many formal duties, the National Assembly exists mainly as a legislative arm of the VCP's Political Bureau. It converts Political Bureau resolutions into laws and decrees and mobilizes popular support for them. In this role, the National Assembly is led by the Council of Ministers acting through the Council of State and a variable number of special-purpose committees. Actual debate on legislation does not occur. Instead, a bill originates in the Council of Ministers, which registers the bill and assigns a key party member to present it on the floor. Before presentation, the member will have received detailed instructions from the party caucus in the assembly, which has held study sessions regarding the proposed legislation. Once the legislation is presented, members vote according to party guidelines. Vietnam's judicial bodies are the Supreme People's Court, the local People's Courts at the provincial, district, and city levels, the military tribunals, and the People's Organs of Control. Under special circumstances, such as showcase trials involving breaches of national security, the National Assembly or the Council of State may set up special tribunals. Judges are elected for a term equivalent to that of the bodies that elected them, and trials are held with the participation of people's assessors, who may also act as judges. The Constitution guarantees defendants the right to plead their cases. Cases are prosecuted by a procurator.

Parishioners who tried to prevent the destruction were beaten by police. Since then, Catholic priests and faithful have been assaulted by uniformed and plainclothes police, and Catholics who try to visit the parish are harassed and beaten; one journalist pummeled to unconsciousness. The latest outrage is a February 24 attack on a group of nuns visiting various parishes in the area. The demolition of crucifix began at 3:00 a.m. with the use of explosives. �On hearing the explosions, parishioners rushed to the site to protect their crucifix but they were stopped by police who tried to drive them back, �said Father Nguyen Van Huu, pastor of Dong Chiem parish. The Archdiocese of Hanoi immediately issued a press release denouncing the government�s actions: �Police attacked the parish today, in the early morning, when both its pastor and the pastor�s assistant were at the annual retreat in the Archbishop�s Office. An estimated 500 heavily armed and well-entrenched police officers and a large number of trained dogs were deployed in the area to protect an army engineering unit that destroyed a large crucifix erected on a boulder inside the parish cemetery.� Parishioners recounted being shot at close range with tear gas canisters, even as they were kneeling in prayer, asking the police to stop the devastation. Other parishioners were beaten with batons.

The 450 member National Assembly - also open to non-party members - is the supreme organ of state, and the only body with constitutional and legislative power. The National Assembly elects the President of the State and the Prime Minister The President has the right to nominate candidates for a number of key positions, including the Chief Justice of the Supreme People's Court, and the Procurator-General of the People's Office of Supervision and Control. The National Assembly then approves nominees. The Prime Minister, who is charged with the day-to-day handling of the Government, has the right to nominate and dismiss the members of his cabinet, though only with the approval of the National Assembly. President Tran Duc Luong is the chief of state, while Prime Minister Phan Van Khai is head of government. General Secretary Nong Duc Manh heads up not only the VCP but also the 15-member Politburo. A decision by any member of the triumvirate is vetted by the other two. As a result, policy announcements tend to be bland and equivocal. In 2001 the constitution was amended to increase the role of the National Assembly by giving it the authority to decide budget allocations and to stage votes of no confidence in office holders. Amendments also boosted the role of the private sector by recognizing the right to operate of any businesses not explicitly prohibited and lifting restrictions on their size. These revisions were intended to encourage the development of a cottage industry of individual traders and private enterprises. In the field of education, amendments established the goals of universal secondary education, more vocational and technical training, and easier access to education by the poor and handicapped.
