    David Josiah Brewer
    January 20, 1837- March 28, 1910 Associate Justice of the U.S. Supreme Court from December 18, 1889 to March 28, 1910 when he died of a heart attack. He was born of American parents in Turkey (Smyrna, Asia Minor [modern Turkey]) where his Father was a Congregationalist Minister and Missionary. His father was there to convert Jews to Christianity. He was a lifelong member of the Congregational Church and active in missionary work. At one point, he was on the board of directors of Washburn University in Kansas which was a Congregationalist college. He didn't attend meetings regularly but apparently did attend some. His uncle (Stephen J. Field) was on the Supreme Court at the same time he was and together they made up the ultraconservative wing of the court. As a supreme Court Justice, he is today largely forgotten. He fits into the "Average" category on most lists ranking Supreme Court Justices. That isn't a raving endorsement of his performance as a justice considering he was on the high court for slightly over twenty years.

    Justice David M. Borden received his Bachelor of Arts Degree, Magna Cum Laude, Phi Beta Kappa, from Amherst College in 1959, and his LL.B., cum laude, from Harvard Law School in 1962. He engaged in the private practice of law in Hartford from 1962-77. From 1963-71, he served as the executive director of the Commission to Revise the Criminal Statutes of the State of Connecticut and he was the chief draftsman of the 1969 Connecticut Penal Code. From 1975-76, he acted as Chief Counsel to the Joint Committee on the Judiciary. He served as a judge of the Court of Common Pleas from 1977-78 and as a judge of the Superior Court from 1978-83.     Posted on 04/30/2009 7:26:56 PM PDT by NPR reports: The court has completed hearing oral arguments for the year and will be issuing rulings and opinions until the end of June. Souter is expected to remain on the bench until a successor has been chosen and confirmed, which may or may not be accomplished before the court reconvenes in October. At 69, Souter is nowhere near the oldest member of the court, but he has made clear to friends for some time now that he wanted to leave Washington, a city he has never liked, and return to his native New Hampshire.

Sure, Obama will replace him with another liberal, but Souter has been a travishamockery of a Judge to quote that Bud Light ad of a while back. Bush 41 really screwed the pooch there. If he had gotten that pick right, Roe v Wade would have been gone for the last 20 years. Affirmative Action would have been history. All those gitmo decisions would have been the other way. I could go on. The key is to hope nothing happens to Scalia or Kennedy. They both turn 73 this year and if one of them goes, we are completely finished on the Court for the next 30 years.

    Michele Salcedo May 1st, 2009 WASHINGTON — After 18 years in a city he loved to hate, Justice David H. Souter can finally bid Washington farewell. Souter was appointed to the court in 1990 by President George H.W. Bush after just a few months as a federal appeals court judge, but with many years experience as a prosecutor, attorney general, trial judge and state Supreme Court justice in New Hampshire. Conservatives worried that in his praise for the liberal lion he succeeded, Justice William Brennan, Souter was charting a much more moderate course than they would have liked or expected from a Republican nominee. He resisted the spotlight that has attracted liberal and conservative justices alike. When writing for the court in 1994 that a state could not create a separate public school district for Hasidic Jewish children, Souter fended off a Scalia dissent in customary fashion. At the American academy, when asked how to approach members of Congress to ask for more money for the humanities, Souter suggested focusing on the history buffs in Congress.

I worked my way through law school helping indigent families and migrant workers with family law issues. I worked for the Palo Duro Legal Aid through the Presbyterian Church in west Texas. The State Bar allowed me to appear in court my third year in law school. I went to work in the Smith County District Attorney's Office trying two or three DWI jury trials a week. I moved into the felony courts and tried every type of criminal offense. I was responsible for keeping murders, rapist and robbers off the street. After two years, I went to work in Upshur County for the District Attorney once again trying the tough cases.

He was graduated from Harvard College, from which he received his A.B. After two years as a Rhodes Scholar at Magdalen College, Oxford, he received an A.B. in Jurisprudence from Oxford University and an M.A. in 1989. After receiving an LL.B. from Harvard Law School, he was an associate at Orr and Reno in Concord, New Hampshire from 1966 to 1968, when he became an Assistant Attorney General of New Hampshire. In 1971, he became Deputy Attorney General and in 1976, Attorney General of New Hampshire. In 1978, he was named an Associate Justice of the Superior Court of New Hampshire, and was appointed to the Supreme Court of New Hampshire as an Associate Justice in 1983. He became a Judge of the United States Court of Appeals for the First Circuit on May 25, 1990.     Some Secular Humanists have argued that the extensive recitation of the history of this Christian nation in the case of Holy Trinity v. U.S. is not relevant to the holding of the case, but is mere obiter dicta an off-hand remark by the judge that really doesn't form the basis of the decision, and shouldn't be considered the official opinion of the Court. Perhaps some people are persuaded that such "obiter dicta" could consume fully half of the Court's opinion. I think it makes more sense to understand the Christian history as the basis or rationale undergirding the case. The Court is saying that an immigration statute ought not to be applied against a church hiring a pastor because "this is a Christian nation." The history of this nation is thus not merely an "off hand" digression from the substance of the case, but is the very basis for the holding. No Secular Humanist I know has ever cited any legal authority whatsoever to support the claim that the Christian history in Holy Trinity is irrelevant to the holding of the case.
