TBI can be classified based on severity, mechanism ( closed or penetrating head injury ), or other features (e.g. occurring in a specific location or over a widespread area). Head injury usually refers to TBI, but is a broader category because it can involve damage to structures other than the brain, such as the scalp and skull. TBI is a major cause of death and disability worldwide , especially in children and young adults. Causes include falls, vehicle accidents, and violence. Prevention measures include use of technology to protect those who are in accidents, such as seat belts and sports or motorcycle helmets, as well as efforts to reduce the number of accidents, such as safety education programs and enforcement of traffic laws. Traumatic brain injury is sudden physical damage to the brain. The damage may be caused by the head forcefully hitting an object such as the dashboard of a car (closed head injury) or by something passing through the skull and piercing the brain, as in a gunshot wound (penetrating head injury). The major causes of head trauma are motor vehicle accidents. Other causes include falls, sports injuries, violent crimes, and child abuse. If you or a loved one has suffered a brain injury and feel it was someone else's fault, find lawyer to discuss your legal options regarding a potential personal injury lawsuit and all surrounding circumstances to be sure your rights have been protected. A personal injury attorney who specializes in your type of injury lawsuit will be the best legal option. Approximately 200,000 Americans die each year from brain injuries. An additional half million or more are hospitalized. About 10 percent of the surviving individuals have mild to moderate problems that threaten their ability to live independently. Another 200,000 have serious problems that may require institutionalization or some other form of close supervision. Of all types of personal injury , those to the brain are among the most likely to result in death or permanent disability. Estimates of traumatic brain injury (TBI) incidence, severity, and cost reflect the enormous losses to individuals, their families, and society from these injuries. These data demonstrate a critical need for more effective ways to prevent brain injuries and care for those who are injured.

A Traumatic Brain Injury (TBI) occurs when sudden trauma to the brain causes damage ranging from a mild concussion to severe injury, coma, and/or death. In some cases, a Traumatic Brain Injury can also be caused by medical malpractice due to a doctor's or medical institution's negligence to diagnose or properly treat an injury. For instance, a doctor may provide an overdose of radiation to treat an underlying condition. Approximately 1.5 million brain injuries occur each year and are a major cause of death or disability in children and adults. An estimated 80,000 to 90,000 people with a traumatic brain injury experience permanent disabilities. According to the Centers for Disease Control and Prevention, it is estimated that approximately 5.3 million Americans living with long-term or permanent brain injuries need assistance to perform tasks of daily living. • Because of this, litigation involving traumatic brain injury has become one of the most complex and demanding types of law in our court systems. The medical battles require vast knowledge and experience on the part of the Plaintiff's lawyers. Why would anyone place a case involving a damaged brain in the hands of a lawyer without extensive experience in brain injury? What are the chances that a lawyer off of a billboard or a "friend of a friend" knows brain injury litigation? The lawyers at braininjury.com are all nationally known leaders in the very complex field of traumatic brain injury litigation.

  • The Causes of Traumatic Brain Injury September 11th, 2010 The Centers for Disease Control and Prevention (CDC) had estimated that there are 1.5 million people in the United States alone that suffer a traumatic brain injury (TBI) each year. Of these 1.5 million people, 50,000 people die and 85,000 suffer from long-term disabilities. The CDC also estimates that more than 5.3 million people with disabilities lives that were caused by traumatic brain injuries. There are, without a doubt, many, varied causes of these brain injuries. The top three causes are vehicle crashes, firearms, and falls. Firearm injuries are often fatal. Of those that are injured due to a firearm, 90% die. Young adults and the elderly are the most at risk for this type of injury. There are a few situations that result in traumatic brain injuries. These are called the mechanisms of injury. The main mechanisms of injury are open head injury, closed head injury, deceleration injuries, chemical and toxic injuries, and hypoxia. Open head injuries are frequently bullet wounds. They involve some sort of object such as a bullet ,a nail, etc. penetrating the skull. Generally, this type of wound has mainly focal damage, or damage that is confined to a small area of the brain. Despite this, the effects of the injury can be as serious as closed brain injuries.

      Brain Injury
My maternal grandfather lived the last 60 or so years of his life with brain damage due to a train accident. Formerly a school teacher, he eventually found work stacking veneer in a veneer mill. He was incontinent at night, wore a rope for belt, looked menacing even though he would never harm anyone, constantly embarrassed his children and grandchildren, and walked everywhere he went. Shouldering the burden without complaint, Grandma ran a mill village grocery store, took in boarders, and held the family together. Every time I represent a client with brain damage, I think of Grandpa and the effect that injury has had on all our lives for three generations. When the brain is injured, the essence of the person is affected. Memory, reason, temperament and personality may all be impaired in strange and inconsistent ways. Traits that were minor idiosyncrasies before may expand into debilitating obstacles. The effect may be devastating to the victim's relationships, occupation, income, school performance, and overall quality of life. However, he may look just fine physically, and may seem normal in casual encounters. To make matters worse, friends, family members, coworkers and employers may not understand or sympathize with an injury they cannot see.

Nearly all of the survivors of a traumatic head injury and their families with whom I have worked have had one complaint: There is nothing written that explains head injury in clear, easy to understand language. Most say the available material is too medical or too difficult to read. The goal of this online book is to better prepare the head injured person and family for the long road ahead. See our Table of Contents below. PUBLICATION HISTORY
This online book came from materials that I wrote for my patients and their family members. I basically used a copy machine and gave copies away for free. This book became very popular and over a thousand copies have been given out. It costs about $6 to copy the book another $3 to $4 to mail to people. The costs and time to send the books got out of hand. I decided not to publish the book. Few people would have access to the material and I would not be able to "update" or improve the material easily. Using the Internet, anyone with a computer could access this information. It is my sincere hope that the Internet version of my book would help the greatest number of people. Go to each chapter heading and click on it. Use your web browser to print any information that you find helpful. There is no charge for the information you copy.
