  • A venerable system of fundamental laws, policies and principles that describe how a government or state is organized and will function. Establishes the powers of the executive, legislative and judicial branches of government, Allocates powers to different levels of government, such as federal, provincial, and municipal. Indicates the rights of each citizen in relationship to each other and to the government, i.e., the Charter of Rights and Freedoms (1982). Outlines how the Constitution is to be amended. The Canadian Constitution is made up of a nucleus of written systematically arranged rules/laws. However, there are also unwritten rules called Conventions. Conventions could also be described as general agreements or longstanding customs on the usages and practices of social life. Both the Nucleus and the Conventions have been interpreted by the courts, and their decisions have lead to Constitutional case law. Needlesstosay, overtime a vast labyrinth of decisions have been made, making the Constitution a multi-facted document and rather outrageous document in terms of its compilation. (see below)
Canada's Constitution is extremely complicated because it was not created from a single draft, like the constitution of the United States. The Canadian Constitution is a quilt, that has been put together piece by piece, with some pieces more elaborate than others (somewhat like the federal tax laws!). The U.S. Constitution, on the other hand is simple and to the point. It consists of seven articles and twenty-six amendments and is the supreme law of the land.

It outlines Canada's system of government, as well as the civil rights of all Canadian citizens. Generally speaking, all British legislation that predates or modifies the British North America Act comprise the Constitution of Canada. The Constitution, as it is generally known, is made up of many parts (see the list below), the most significant that are most often cited today are:
  • Constitution Act, 1867 . Formerly known as the British North America Act, 1867, this was an act of the British Parliament that granted Canada self-government, and outlined how Canada's system of government would operate. Constitution Act, 1982 . This granted Canada full political independence from Britain, incorporated a Canadian Charter of Rights and Freedoms outlining the individual rights of every Canadian citizen and created a constitutional amending formula.
Since the Charter has become the most often cited portion of the Constitution. The predecessor acts and orders that are listed below are generally not as well known. These acts have sometimes been denounced as "messy," "almost incoherent" or worse for their somewhat convoluted form and long, unconsolidated history. However, they remain the laws that determine the division of powers between federal and provincial jurisdictions, the terms upon which new provinces entered Canada and the division between executive, legislative and judicial areas of power in a manner very different from the United States.

The Canadian Constitution is the founding legal document of Canada. It is comprised of the British North America Act of 1867, the subsequent modifications made by the British Parliament until 1975, and the modifications written in the Canadian Constitution Act of 1982, which formally made the Canadian Constitution a Canadian Law. While it reprised most of the 1867 Act, it added four parts: the Canadian Charter of Rights and Freedoms, the Rights of the Aboriginal Peoples of Canada, the Equalization and Regional Disparities, and a Procedure for Amending Constitution of Canada. Enacted in 1982, it was applied from 1985. Its purpose, much like the American Constitution, is to protect Canadians from government over-extending itself into the rights of the individuals. The Constitution was not approved by referendum, but rather by every provincial Legislative Assembly. The province of Quebec still has not ratified the Constitution, which nonetheless applies to the province.

          Broadcast Date: April 17, 1982 Thanks to Trudeau's hard work and determination, the Constitution has made its long journey home after receiving endorsement from the British Parliament. Canada is at last a fully sovereign nation. Trudeau describes the Constitution and its new Charter of Rights and Freedoms as our defining touchstone. But, his comments are tempered by Quebec's marked rejection and he acknowledges the chasm that now exists. In this CBC live footage of the patriation ceremony, Trudeau and the Queen speak of Canada's limitless future. Bringing home the Constitution • Trudeau had been talking about "patriating" Canada's Constitution (which had formerly been held by Britain) and creating a constitutional declaration of rights since before he first became prime minister.
