    PART I
    CANADIAN CHARTER OF RIGHTS AND FREEDOMS
    Whereas Canada is founded upon the principles that recognize the supremacy of God and the rule of law: Guarantee of Rights and Freedoms The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society. Fundamental Freedoms Everyone has the following fundamental freedoms: a ) freedom of conscience and religion b ) freedom of thought, belief, opinion and expression, including freedom of the press and other means of communication. c ) freedom of peaceful assembly; and d ) freedom of association. Democratic Rights Every citizen of Canada has the right to vote in an election of members of the House of Commons or of a legislative assembly and to be qualified for membership therein. (1) No House of Commons and no legislative assembly shall continue for longer than five years from the date fixed for the return of the writs at a general election of its members.( (2) In time of real or apprehended war, invasion or insurrection, a House of Commons may be continued by Parliament and a legislative assembly may be continued by the legislature beyond five years if such continuation is not opposed by the votes of more than one-third of the members of the House of Commons or the legislative assembly, as the case may be.(

    ... The Politics of Canada Portal The Constitution Act, 1982 (Schedule B of the Canada Act 1982 UK )) is a part of the Constitution of Canada . The Act was introduced as part of Canada's process of " patriating " the constitution, introducing several amendments to the British North America Act, 1867, and changing the latter's name in Canada to the Constitution Act, 1867 Elizabeth II as Queen of Canada brought the act into effect with a proclamation she signed in Ottawa on April 17, 1982. The Canadian Charter of Rights and Freedoms forms the first thirty-five sections (counting section 16.1 , and not counting section 35 ) of the Constitution Act, 1982. To the present day, the Government of Quebec has never formally approved of the enactment of the Act, though formal consent was never necessary. The Meech Lake and Charlottetown Accords were designed to secure approval from Quebec.

    The Constitution of Canada is the supreme law in Canada. It is an amalgam of codified acts and uncodified traditions and conventions. It outlines Canada's system of government, as well as the civil rights of all Canadian citizens.

    A constitution provides the essential framework for orderly government and for relations between people and their government. Canada's Constitution is not a single document as in the United States. It is made up of acts of the British and Canadian Parliaments, as well as legislation, judicial decisions and agreements between the federal and provincial governments. It also includes unwritten elements such as British constitutional conventions, established custom, tradition and precedent. Responsible government, for example, in which the Cabinet is collectively responsible to the elected House of Commons and must resign if it loses a vote of confidence, is a fundamental, but unwritten, element of Canadian parliamentary democracy at the federal and provincial levels. The Constitution's basic written foundations are the Constitution Act, 1867, which created a federation of four provinces — Ontario, Quebec, Nova Scotia and New Brunswick — under the British Crown, and the Constitution Act, 1982, which transferred formal control over the Constitution from Britain to Canada and entrenched a Canadian Charter of Rights and Freedoms and procedures for constitutional amendment.

    DECEMBER 2, 1981 During the 1980s things, in some ways, began to change radically. Legislation repatriating the Canadian Constitution from the United Kingdom was enacted by Canada's Parliament on December 2, 1981 - it was signed into law at a ceremony in Ottawa by Queen Elizabeth II on April 17, 1982. Some recognition was given to First Nations under Section 35, but this was no revolutionary development. A constitutional conference, mandatory under the provisions of the Constitution, was called to find a method to entrench First Nations self-government. The conference was held and it flopped. Canada was not yet willing to recognize First Nation inherent right to self-government, but at least the proposal is still on the table. I attended the conference as an observer. The thing I recall most vividly was what a very highly placed provincial official said to an aide, in an unguarded moment, as he walked through the foyer of the building where the conference was being held. Not aware that I was within earshot he stated: "I don't give a fuck what those fucking Indians want, they're not getting it."
