The army of 1914 was, as all armies are, governed by regulations and military law. Military law in the British Army has always been an extension of criminal law, which means that there are military offences in addition to those that would be tried by a civil court. Most minor offences, up to battalion or regiment level, were dealt with by the unit commander. Major offences were dealt with by court-martial and were referred to higher formation command. There, they would invariably call for the Provost Marshall (PM) or Assistant Provost Marshall (APM) who was responsible for the maintenance of discipline and the military police within that formation. The System The basic premise of the system in peacetime was, if it is between soldiers, it's military, if civilians are involved, it's civil. On active service, everything was military including those crimes that would have been tried by a civil court. Unit and sub-unit commanders had the job of hearing the offence. A Summary of Arguments Presented at a Meeting of the Men's International Theosophical League of Humanity, March 31, 1914 [Included in To Abolish Capital Punishment: A Plea to the Citizens of every Country , Point Loma, California, 1914.] Capital punishment is a barbarous survival from a less enlightened and refined age; it is incongruous and incompatible with our present standard of civilization and humanity. It has been abolished by many states and countries, and we must look forward to the day when the other governments will follow suit. The arguments against capital punishment are many and cogent, but the pleas advanced in its favor are few and specious. Punishment is supposed to be for the protection of society, and for the reformation of the wrongdoer. It purports to protect society by preventing the same criminals from repeating their crimes, and by acting as a deterrent to other prospective criminals. Capital punishment is a notorious failure in these respects. It does indeed remove the particular culprit from the possibility of repeating his crime; but this is of very small account in view of the fact that murder is seldom a career of repeated acts, but consists of single acts perpetrated by different individuals. The man whom we remove from the scene, therefore, is not the man who, if suffered to live, would have been likely to endanger our safety. As a deterrent to other murderers, likewise, the death penalty has proved a signal failure, as may be seen by comparing the criminal statistics of those countries where the punishment is in force with those of countries where it has been abolished. Nor is the reason of this failure far to seek. Murders are nearly always committed in sudden fits of passion or temporary insanity, when no consideration of reason or self-interest can appeal to the doer. Further, such uncertainty attends the consummation of the death sentence due to the natural hesitation and inclination to mercy of judge and jury, to the chances of reprieve and commutation that this penalty is far less deterrent than are those penalties which, though less severe, are also more certain. Finally, we have not answered the question whether there are not other and more effective deterrents; and, there are such deterrents, in comparison with which capital punishment is seen to be clumsy and ineffectual in the extreme.

There are many people who feel exactly that way about the Federal Government, just ask Mr. McViegh, and some of the people from Waco, Texas. Also, I wonder how is it fair? And to whom? First, the deceased has a family, perhaps dependents, and these are left harmed and unhelped for the most part. There is no restitution by the killer. And the innocents who have lost a loved one must also bear their trauma and suffer its exacerbation through a trial and dealing with lawyers for God's sake. Then there are the dependents and family of the killer who have losses through no fault of their own. The victims pay, the society pays, the friends and family of the killer pays. The killer simply leaves this "veil of sorrow." So where is the equity in that arrangement?

How would you react if somebody raped and murdered your child?

I have often been asked this question by supporters of the death penalty, and my answer is: My first reaction would probably be a strong wish to cut the balls off the bastard, to tear him apart and kill him.
But my next reaction would hopefully be gratitude for living in a constitutional state where the principle of personal revenge has been replaced by societies obligation to administer an appropriate punishment and give me the necessary support to get a decent life in spite of my loss.
Another frequent question: Why don't you care about the victims and their relatives?

Thirty-eight states allow the death penalty and twelve states disallow the death penalty. Like abortion, it is a hotly debated issue. The primary problem with the Death Penalty as it stands today is that it results in executing many innocents. In 1915, Joe Hill was executed and was later proven innocent. There are obviously major flaws with the system as it stands. To quote a qualified source in regards to Capital Punishment... "Whether you support or oppose capital punishment, there is mounting evidence that the system is broken. A review of death penalty judgments over a 23-year period found a national error rate of 68 %. In a matter of life and death, we are getting it wrong more than 2 out of every 3 times. We need a moratorium on executions to give us time to figure out why the system is not working." [*ACLU.] At this point, it would be obvious even to the most uneducated person that the Death Penalty is surely no proper system. Even if one person who was innocent was executed amongst a billion people, it is a broken system. The government thus displaces its duty from protecting the innocent citizens to outrightly executing them. If the public can be protected from convicts simply by the government stationing the convicts in prison, then surely, the convicts should be stationed in prisons. Thus far, I have not examined the death penalty itself, but have addressed the method it has been carried out. There are large amounts of innocent people who are killed, and even to their last dying breath, they still claim their innocence. It is only after their life is snuffed out forever that we learn of their innocence. This system is largely faulty. However, thus far, I have given no opinion on the murder of a man for his past crimes. The question now arises:
