You may have no idea that you are a criminal target until the FBI or a local law enforcement agency shows up to seize your computers. The Fourth Amendment generally prohibits law enforcement from accessing and viewing information stored in a computer without a warrant .1 The law, however, can be counter intuitive. depending on the circumstances. For example: the Fourth Amendment does not apply to searches conducted by private parties who are not acting as agents of the government - such as an employer. 2 If you are charged with an internet crime it is important that you that you refuse any requests to access your computer or other electronic storage media without a warrant. What is the profile of a computer criminal?
Some individuals attempt to make generalizations about criminals who use computers. This is not profiling; it is unsafe speculation. Teaching investigators that future criminals will fit into a static mold can mislead an investigation, potentially delaying or thwarting the apprehension of an offender. Criminal profiling is the process of examining a crime scene for physical and behavioral evidence that can be used to gain a better understanding of the crime, victim/target and offender. For more information also see Casey, E. "Criminal Profiling, Computers, and the Internet," Journal of Behavioral Profiling , May, 2000, Vol. 1, No. 2

Computer Crimes The term Computer crime , also referred to as cybercrime, e-crime or hi-tech crime, represents unlawful activities involving computers as a target, venue or tool. With the advent and proliferation of the Internet, computer crimes have evolved from embezzlement and fraud to complex crimes involving hacking, identity theft, pornography, and sexual exploitation. In 1985, the state of Texas passed a computer crime law, which has since been amended several times, in keeping with the rapid evolution of computer technology. Some of the highlights of the law computer crime law are:
  • It is illegal to access someone else’s computer without consent or use their password to obtain personal or confidential information. Further, if a person benefits from accessing and obtaining information, they can be charged with a felony. It is unlawful to intentionally damage or destroy a computer that is public property or the property of someone else.

04-10-2008, 10:53 PM Hello all. I am doing a research paper for a computer class I am taking in college. I wanted to do mine on Computer/Internet Crimes. I got a lot of information from the FBI website and I know there is a lot more info out there, but I have more of a "jurisdictional" question...
When does an internet or computer crime go from local to state to federal? Does it automatically go to agencies such as the FBI or state police, or does it stay local until it gets to a certain point? Any and all info will be greatly appreciated.
Thank you. Stay safe out there. 04-11-2008, 01:53 AM Depends on state laws. Anything criminal act that includes crossing a state line could fall under the jurisdiction of the FBI, but the FBI will rarely handle such cases unless they're of a serious nature. For the most part, a local agency will investigate computer crimes and, if they come to the point of gathering enough probable cause to make an arrest, will seek the cooperation of the state where the offender resides (assuming that the offender lives in a different state, of course). 04-11-2008, 04:02 AM
