    GOVERNMENT
    In December 2005, roughly two-thirds of eligible Congolese voters participated in a referendum that resulted in approval of a new constitution. This constitution entered into force in February 2006. Extensive executive, legislative, and military powers are vested in the president. The legislature does not have the power to overturn the government through a vote of no confidence. The judiciary is only nominally independent. The president, due to the absence of the as-yet-unestablished Conseil Superieur de la Magistrature (supreme judicial council; CSM), has the power to dismiss and appoint judges. The president is head of a cabinet of ministers. The current cabinet, appointed in February 2010, has 37 ministers.
    The D.R.C.'s July 2006 elections presented significant organizational challenges. The presidential and legislative ballots were printed in South Africa and altogether weighed nearly 1,800 tons, requiring 75 round-trip flights between the D.R.C. and South Africa. The CEI, greatly supported by the MONUC peacekeeping mission, ran more than 50,000 polling stations nationwide and employed some 300,000 poll workers on election day and to oversee the ballot-counting process. In July 2010, President Kabila signed into law the establishment of a permanent National Independent Electoral Commission (CENI) to replace the transitional CEI. Presidential and parliamentary elections are scheduled for November 27, 2011. Local elections have been tentatively scheduled for 2012.

    A senior government minister in the Democratic Republic of Congo has been released after being seized by ethnic militiamen in the north-east three days ago. Ntumba Luaba-Lumu told the BBC Focus on Africa programme that he had not been physically assaulted but that he had been kept under constant armed guard. The Congolese human rights minister was abducted by militiamen from the Hema ethnic group after he went to the town of Bunia to try to mediate in clashes involving another group, the Lendu. One report suggests the minister was freed in exchange for the release of Hema militiamen being held by the Kinshasa government. The north-eastern Ituri region has for years seen fierce clashes between the Hema and Lendu in a long-running feud over land. More than 100 people were killed in ethnic and faction fighting earlier this month.

Forty members of the ruling coalition, the Alliance for the Presidential Majority, joined 86 opposition members in support of the motion today, Francois Muamba , leader of the opposition Movement for the Liberation of Congo, said by phone in the capital, Kinshasa. Prime Minister Adolphe Muzito ’s government has ceded too much power to the president, failed to improve the security of the country, and neglected to increase the number of provinces from 11 to 26 as required by the constitution, Muamba said. The prime minister was meeting with delegates from the United Nations Security Council and didn’t answer his phone when called for comment. The Security Council is in Congo to discuss the renewal of the mandate for its peacekeeping force, which arrived in the country in 1999 to help end a war. The motion would pass with a simple majority of 251 votes in the 500-member assembly, and result in the fall of the government, Muamba said.
