September 10, 2001 2001-R-0696 PATIENT PROTECTION -COMPARISON OF FEDERAL PROPOSALS AND STATE LAW By: John Kasprak, Senior Attorney Jerome Harleston, Senior Attorney You asked for a comparison of the federal House and Senate bills on "patient protection" with existing Connecticut law. You wanted us to use a recent Congressional Research Service (CRS) report comparing the House and Senate bills as the basis for the comparison with Connecticut law. BACKGROUND The United States House of Representatives and the Senate have each passed different versions of a "patient protection" act. The Senate version, S. 1052, passed on June 29 of this year while the House version (H.R. 2563) was adopted on August 2. The most significant differences between these two versions are in the provisions expanding patients' legal remedies against their health plan providers when medical care is unjustly denied and the denial results in harm. Other differences involve applying the protections to federal health programs, prohibiting discrimination on the basis of genetic information, and encouraging health insurance coverage expansions. A conference committee will determine the final version of the legislation. Connecticut has passed two significant pieces of legislation providing protections to patients enrolled in managed care plans, Public Acts 97-99 and 99-284. (A recent OLR Report, No.

Statutory Authority

The Connecticut Law Revision Commission conducts an ongoing review of Connecticut Law and recommends appropriate revisions to antiquated, unconstitutional, and inequitable laws. The Commission assists the Judiciary Committee and other legislative and executive bodies on specific revision proposals and solicits the expertise of numerous state legal authorities in arriving at its consensus on recommendations.
The Governor, Leadership of the General Assembly, and Judiciary Committee Co-Chairmen and Ranking Members each appoint members to the Commission, which presently consists of two senators, four representatives, one judge, one law school professor, and seven attorneys.
The Law Revision Commission is supported by the staff of the Legislative Commissioners’ Office.
