Eritrea : Government
Eritrea's Government faced formidable challenges. Beginning with no constitution, no judicial system, and an education system in shambles, it was forced to build the institutions of government from scratch. The present government includes legislative, administrator, and judicial bodies. The legislature, the National Assembly, includes 75 members of the PFDJ and 75 additional popularly elected members. The National Assembly is the highest legal power in the government until the establishment of a democratic, constitutional government. The legislature sets the internal and external policies of the government, regulates implementation of those policies, approves the budget, and elects the president of the nation. The president nominates individuals to head the various ministries, authorities, commissions, and offices, and the National Assembly ratifies those nominations. The cabinet is the nation's administrator branch. It is composed of 17 ministers and chaired by the president. It implements policies, regulations, and laws and is accountable to the National Assembly. The ministries are agriculture; defense; education; energy and mines; finance; fisheries; foreign affairs; health; information; labor and human welfare; land, water, and environment; local governments; justice; public works; trade and industry; transportation and communication; and tourism. Nominally, the judiciary operates independently of both the legislative and administrator bodies, with a court system that extends from the village through to the district, provincial, and national levels. in practice, the freedom of the judiciary is limited. In 2001, the president of the High Court was detained after criticizing the government for judicial interference.

Head of government: President Isaias Afwerki President Isaias Afwerki. President Isaias Afwerki and his cabinet of 16 ministers, regional governors and other officials form the 24-member State Council, the executive branch of the Eritrean government, chaired by the president. An unicameral 150-member National Assembly which comprises 75 Central Committee members of the ruling PFDJ, together with 75 others (representatives elected by the general population, of whom at least 11 must be women, and 15 members representing Eritreans living abroad) form the legislative branch of the democratic government of Eritrea. The National Assembly establishes the domestic and foreign policies of the government, regulates the State Council's execution of these policies and approves the country's budget. The National Assembly elects the president directly. The judiciary consists of courts at national (Supreme Court), regional (10 provincial courts), and village levels (29 district courts). Special Sharia courts subjugate to the Muslim population, following Islamic Sharia law in family cases.

Commission members traveled throughout the country and to Eritrean communities abroad holding meetings to explain constitutional options to the people and to solicit their input. A new constitution was ratified in 1997 but has not been implemented, and general elections have not been held. The government had announced that Transitional National Assembly elections would take place in December 2001, but those were postponed and new elections have not been rescheduled. Nominally, the judiciary operates independently of both the legislative and executive bodies, with a court system that extends from the village through to the district, provincial, and national levels. In practice, however, the independence of the judiciary is limited. In 2001, for example, the president of the High Court was detained after criticizing the government for judicial interference.

ERITREA: Government expects more deportees as displaced numbers grow NAIROBI, 31 March (IRIN) - The Eritrean government is planning for the arrival of 50,000 Eritreans from Ethiopia during 1999. They would join over 55,000 who have already arrived since the outbreak of the conflict between Ethiopia and Eritrea last May, officals say. In the latest explusions, the Eritrean Ministry of Foreign Affairs on Wednesday announced that 1,501 Eritreans were sent back from Ethiopia over the weekend. The deportations take place despite ongoing clashes on the ground along the common border. Eritrean officials say there are about 75,000 Eritreans still in Ethiopia.. A spokesman for the Eritrean Relief and Refugee Commission (ERREC) told IRIN today that the government's latest appeal for all war-affected populations targets up to 550,000 people in need. Since last year, donor interest "has grown" in supporting humanitarian programmes for the displaced, the ERREC official said, while mentioning that last year's ERREC appeal was about one-third funded. From the UN, UNDP is donating about US $2.2 million to the displaced persons' programme. The human cost of the war in the Horn of Africa is enormous. Both Ethiopia and Eritrea claim to have killed, wounded or captured tens of thousands of troops. Hundreds of thousands of civilians have been displaced over the last 10 months because of the conflict. Border villages and towns have been evacuated, where previously co-habiting communities from the respective countries have become divided and homeless. The latest appeals and figures from Ethiopia and Eritrea put the expected caseload of war-displaced civilians in need of humanitarian assistance in 1999 at around 931,000 people.
