You may think the love and responsibilities you share with your partner are exactly the same as that of your non-gay family and friends, but alas, the law sees it another way. A marriage bestows concrete legal and tax benefits to both husband and wife. However, the laws generally do not recognize the same rights and privileges for same-sex couples. Since gay or lesbian couples lack the same concrete tax, inheritance and employment benefits that marriage bestows, these benefits must be created through the use of estate planning documents and contracts. The Estate Plan You Can't Afford For those who have not planned their estate, you may be happy to know that the State of California has prepared an estate plan for you free of charge. This state provided estate plan is referred to as "intestacy." Under the laws of intestacy, the estate of a person who dies without a will or trust will pass (after lengthy and costly probate proceedings) to biological relatives under the traditional family model. There are two problems with intestacy. The first and most important problem is that most state intestacy laws discriminate against same-sex couples in that gay and lesbian relationships are generally considered invalid for purposes of distributing the estate of a deceased partner who dies without a will. Generally, under intestacy laws, a surviving partner will be left with nothing upon the death of a partner. This is true irrespective of the length and intensity of the relationship between the deceased partner and the surviving partner. California, however, has made substantial progress in reversing this discrimination. Under the laws that took effect on January 1, 2005 ("

LLCs and Charging Orders
A recent Florida Supreme Court decision, Shaun Olmstead, et al. v. Federal Trade Commission , is the latest case in a string of cases involving a few state Courts that have held that a sole member LLC does not receive charging order protection from creditors. A charging order restricts a creditor from obtaining the debtor’s LLC voting interest or the LLC property. The charging order only allows the creditor to receive whatever income the debtor would receive. The theory for charging order protection is that it is unfair to the other LLC members (or in the case of a Partnership, the partners) to allow an outside creditor to take ownership of a debtor-member’s LLC interest. Charging order protection applies to LLCs and Partnerships but not to owners of corporations. Therefore, besides being estate planning tools, LLCs and Partnerships are often used for asset protection. However, according to the Florida Supreme Court and a few other state Courts, if there is only one LLC member the charging order protection should not apply. Sole member LLCs do not enjoy creditor protection in Virginia. Other states, such as Wyoming, have statutes to protect even sole member LLCs.

As life progresses and goals shift, the estate plan should move to be in line with new goals. Lack of adequate estate planning can cause undue financial burdens to loved ones (estate taxes can run higher than 40%), so at the very least a will should be set up even if the taxable estate is not large.

Before shelling out a lot of money for professional fees, take some time to learn the basic issues. The three most common approaches you will hear about are use of a living trust to avoid probate, use of a tax savings trust to reduce estate taxes, and buying life insurance to pay estate taxes that may be due. All of these methods are good for some people, but none of them are good for everybody. Do your homework using free resources on the net, and then obtain professional consultation after you are sure you need it. When used appropriately, attorneys and estate advisors can be of great help.

To formulate a legally valid estate plan, you will need the services of a professional familiar with estate planning, preferably one who has expertise in planning for parents of persons with disabilities.
Parents of disabled children face unique challenges in planning for their children's social, medical and financial needs. Planning for the unthinkable allows you to take control of your child's emotional and financial security. It will also give you peace of mind to know that your child will be cared for in the way you intended.
Many families believe that they have so few assets that an estate plan is not necessary. This is not true. We often have more assets than we realize, although some assets may become important only after our death. The most notable asset of this type is life insurance. Therefore, whether you consider yourselves a family of substantial means or with little or no assets, estate planning should be done. The primary factor will be whether or not your son or daughter receives (or may one day need to depend on) government benefits such as Supplemental Security Insurance (SSI), subsidized housing, personal attendant care, or Medicaid. If, he or she acquires too many assets through inheriting all or part of your estate, he or she may be ineligible for these benefits. Therefore, in order to protect your son or daughter's eligibility for government benefits at some point in the future and to provide for his or her long-range needs, you may need to consider establishing a special estate plan.
