All states currently have some type of "grandparent visitation" statute; through which grandparents and sometimes others (foster parents and stepparents, for example) can ask a court to grant them the legal right to maintain their relationships with loved children. But state laws vary greatly when it comes to the crucial details, such as who can visit and under what circumstances. The following is important when grandparent visitation rights are considered. They can be quite different from state to state and are subject to change.
  • Best Interest of Child
  • Must Show Harm
  • Prior Grandparent/Grandchild Relationship
  • Effect on Parent/Child Relationship
  • Any Marital Status of Parents
  • Parents are Deceased, Divorced and/or Unmarried.
  • After Stepparent Adoption
The requirements for court ordered visitation vary by state. In most, but not all states, if the grandchild's parents are still married the grandparents are not entitled to visitation. Depending upon the state, the following situations may give rise to grandparent visitation:
  • Pending divorce
  • Parents already divorced
  • Parent deceased
  • Child born out of wedlock
In recent years, the issue of Grandparent's rights to visitation in divorce has come to the forefront. Sadly, what will often happen in divorce are the parents of the non-custodial parent end up cut off from their grandchildren. This may be especially true if the grandparents and grandchildren live a far distance from each other.

San Jose Family Law Attorney Discusses the What Happens to the Children When a Parent Dies With the death of Michael Jackson, and a potential custody battle arising between Katherine Jackson, the mother of Michael and Debbie Rowe, Jackson’s second wife and the biological mother of Prince Michael, 12, and Paris, 11, much talk has arisen about what happens when a custodial parent dies. Generally, if a custodial parent dies while the child is a minor, the surviving parent would be entitled to sole legal custody . Other third parties such as aunts, uncles or grandparents may try to obtain custody of the child by filing an independent proceeding such as a guardianship dependency or in the case of grandparents, a Petition for Grandparent Visitation . The other family members may be awarded custody if they can show that it would not be in the child’s best interest to be in the custody of the surviving parent and to do so would be detrimental to the child.

    Posted on October 31, 2008 by J. Benjamin Stevens The recently published an excellent article by Aaron Larson which examines the issue of grandparents' rights with regard to visitation. This article gives the background and current state of federal law with regard to this issue, particularly in light of the U.S. Supreme Court's decision in Troxell v. Granville from 2000. Mr. Larson explains that the main arguments made by those in favor of grandparents' rights include:
    • Grandparents may provide a stabilizing role in their grandchildren's lives, particularly after a divorce or crisis (such as the death of a parent). Where grandparents have been involved in a child's life, it can be traumatic to the child to suddenly be denied access. The mere fact that parents are divorced, or the grandparents's child dies or is incarcerated, should not automatically serve to grant the custodial parent the right to sever a positive relationship between the grandparents and their grandchildren.

The court may grant reasonable visitation rights to the grandparents of the child and issue any necessary orders to enforce the decree. How Far Do Grandparents' Rights Extend?
Do parents always have priority over grandparents? Our Santa Clara family attorneys, who have worked with many grandparents’ rights and child custody cases , have confronted custody struggles between parents and grandparents in numerous contexts, and a highly contentious child custody case that is currently unfolding in Huntingdon, Tennessee, indicates that there is not always an easy answer to this question. For the last year and a half, Mary Winkler’s children have lived with their father’s parents, and now Mary wants them back. She has served a small jail sentence, and is now free on probation.
Her jail sentence, however, was for shooting her husband to death with a shotgun that she does not remember pulling out of the bedroom closet.
After a jury found Mary Winkler guilty of voluntary manslaughter due to her testimony detailing years of emotional and physical abuse at the hands of her preacher husband, she served seven months in jail, including two months in a mental institution for post traumatic stress syndrome. In the state of Tennessee, a parent’s rights may be revoked if that parent “wrongfully” kills the other parent. Yet this law has only existed for several years, providing little legal precedent with which to rule on the Winkler case.
