their children to make a clean break from their ex-spouse or deceased spouse for various reasons. Because of this very
one of the following circumstances was present: 1) one or both parents were deceased; 2) the marriage between the
parents was dissolved; 3) a parent of the child had deserted the child; or 4) the minor child was born out of wedlock.
This statute was later amended to state that there could be reasonable visitation even if the parents were living together
and still married.
In 1996, the constitutionality of Chapter 752 was questioned in Beagle v. Beagle, 678 So.2d 1271 (Fla. 1996). The
Court held that it is not sufficient that grandparent visitation may be in the best interests of the child. Rather, in order for the government to award visitation over the objections of a married parent, the grandparents must first demonstrate the

    Delaware statutes allow grandparents "reasonable visitation rights" as determined by the court. However, when the parents of the child have an intact marriage and object to grandparent visitation, the court is unlikely to grant visitation in opposition to the parental wishes. The best interest of the child is, of course, always considered. The court may consider such factors as the wishes of the child and the nature of any prior relationship with the grandparent when determining the child's best interests. Delaware law further provides that if workable, the maternal grandparents should visit when the child is with the mother, and the paternal grandparents when the child is with the father. Adoption cuts off all visitation rights of grandparents.

In certain family situations, grandparents need to use the legal system to secure their rights and to provide for their grandchildren's needs. For many children, grandparents are the adults in their lives who perform the routine activities typically associated with traditional parents. They provide for the child's needs, make important decisions, and offer the stability and guidance children need. In some situations, grandparents exercise these roles with the cooperation and consent of the child's parents, and no legal intervention is needed. Other times, such as in a divorce, grandparents who were once important or even central in their grandchildren's lives are considered part of the spouse being divorced, and get pushed away from the children. The effect of this on the children and the grandparent can be devastating. New Hampshire's Parenting Rights and Responsibilities law makes special provisions for Grandparents Rights .     In Florida, as in other states, grandparents have a limited right to get court-ordered visitation. As always, the fundamental right held by parents to determine how their children are raised and who visits them is balanced against the best interests of the child in question. Several conditions must be met before a court will grant visitation rights to grandparents in Florida. First, the court must find that visitation by the grandparents is in the interest of the child, and at least one of the following conditions has been met:

    zSB(3,3) Utah law refers to the "rebuttable presumption" that a parent's decision about grandparent visitation is in the best interest of the child. The Utah Code lists several factors relevant to rebutting the presumption. These include the following:
    • Whether the grandparent is a fit and proper person to have visitation rights
    • Whether visitation with the grandchild has been denied or "unreasonably limited"
    • Whether the parent is unfit or incompetent
    • Whether the grandparent has served as custodian or caregiver to the grandchild, or otherwise has had such a substantial relationship with the child that cessation of the relationship would harm the grandchild.
    • Whether the grandparent's child has died or become a noncutodial parent through divorce or legal separation
    • Whether the parent who is the child of the grandparent has been missing for an extended period of time.
