Contractors and employees. Our son has been working for a landscaping firm for two years. He is paid on an hourly basis, but he believes he is paid as a contractor.

  • Our son has been working for a landscaping firm for two years. He is paid on an hourly basis, but he believes he is paid as a contractor. He supervises a junior and communicates with the boss by telephone. At the end of each job, our son sends in an invoice. He is not paid when between jobs, he cannot delegate jobs to someone else, nor does he supply his own tools. He has his own ABN and he pays his own tax, but he doesn't get superannuation, sick leave, etc., and he can't afford his own accident or public liability insurance. Is he a contractor or an employee?     (November 2006) Answer Decisions by courts throughout Australia have now reasonably clearly defined what a contractor is: and by inference what an employee is. If most of the following apply, the person is probably a contractor, but if most don't apply the person is probably an employee who should be employed as such and receive all employee benefits.
    • The person is employed to do a job and then leave. The person is paid for the job rather than by the hour. Person decides how and when to do the job so long as it is finished on time. The person fixes mistakes at his own expense. The person can delegate the work unless the contract states otherwise. The person supplies his own machinery and tools and is responsible for their maintenance. The person is paid on invoice. No holiday, sick pay superannuation, etc. is paid. The person pays his own tax. The person has a ABN. The person has his own accident and public liability insurance. The person works for other people as well as you and promotes himself as an independent contractor.

    General Background : In the XII National Assembly, there are also two women Chair-persons. Women are not represented on the Committee on Military and Defence, and compared with the 11th legislature; they lost (a little) ground on the Committee on Finance and Budget. A new committee on economics, however, was created in the XII legislature and women represent 8.3% of its membership. Still comparing these two legislatures, women representation on the Committee for Social Affairs, the Committee on Culture, Education and Youth, and the Committee on Foreign Affairs diminished. Women's representation did improve on the Ethnic Minorities Council (where they are now in the majority), the Committee on Technology, Science and the Environment and; the Committee on Law. In line with the National Strategy for the Advancement of Women to 2010 and the Law on Gender Equality (passed in November 2006), strengthening the capacity of female Deputies should receive priority attention.
