If most of the following apply, the person is probably a contractor, but if most don't apply the person is probably an employee who should be employed as such and receive all employee benefits. The person is employed to do a job and then leave. The person is paid for the job rather than by the hour. Person decides how and when to do the job so long as it is finished on time. The person fixes mistakes at his own expense. The person can delegate the work unless the contract states otherwise.
