We believe that the immunity issue must be determined in each case on the basis of the individual state laws involved. Since Mt. Healthy we have considered school districts' Eleventh Amendment immunity directly in two cases. We denied immunity to Kansas school districts, Unified Sch. Dist. No. 480 v. Epperson, 583 F.2d 1118 (10th Cir.1978), and granted it to New Mexico school districts, Martinez v. Board of Educ., 748 F.2d 1393 (10th Cir.1984), based upon the particular facts of those cases. In Bertot v. School District No. 1, Albany County, Wyo., 613 F.2d 245 (10th Cir.1979) (en banc), we noted that the issue of Wyoming school district immunity under the Eleventh Amendment was not directly implicated, but assumed that Mt. Healthy had resolved the issue against a finding of immunity. See id. at 248 n. 3. II B C Any monetary damages awarded to plaintiff in this case would not come directly from the state treasury, but would be assessed against the school board, which would then seek indemnification from the Risk Management Fund. The local district is not funded directly from general state revenues, but rather through local property tax assessments supplemented by state grants. An award in plaintiff's favor would therefore not run solely against the state, and would not be barred by the Eleventh Amendment.

In its daily functioning, the Department of Education (as overseen by the Board of Education), provides a single repository of educational data received from school districts, universities, community colleges and independent postsecondary schools. This enables the Department of Education (DOE) to track student performance over time and in various educational venues. May 2002 Also available as PDF This paper is part of a series of nutrition policy profiles prepared by Prevention Institute for the Center for Health Improvement (CHI). Background The proliferation of competitive foods has raised concern among public health officials, parents, teachers, and others since many of these foods can undermine children's diets and health. National studies have found that 78 percent of high schools, 65 percent of middle schools, and 31 percent of elementary schools offered foods a la carte. A la carte items are foods sold individually by school food service during meal times rather than as part of a complete National School Lunch Program meal. A recent California study found that in 71 percent of surveyed school districts, a la carte items accounted for up to 70 percent of all food sales at schools, with popular items including fast foods such as pizza, cookies, and chips. Unlike the National School Lunch Program, these foods are not required to meet any nutritional standards. The high presence of fast foods as a la carte items is a concern, as they tend to be of limited nutritional value and contain high levels of fat, salt, and sugar.
