Stat. 50 U.S.C. ch.36 ) is an Act of Congress which prescribes procedures for the physical and electronic surveillance and collection of "foreign intelligence information" between "foreign powers" and "agents of foreign powers" (which may include American citizens and permanent residents suspected of being engaged in espionage and violating U.S. law on territory under United States control).     Foreign Intelligence Surveillance Act (FISA)
    Updated: April 1, 2010 The Foreign Intelligence Surveillance Act was enacted in 1978, passed in response to revelations by the Church Committee showing widespread abuse of government wiretaps, and to growing concerns on the part of the Supreme Court over eavesdropping practices. The law governs the surveillance of people in the United States for the purpose of collecting intelligence related to foreign powers. A special, secret court, known as the Foreign Intelligence Surveillance, or FISA, court was created to hear requests for such warrants. Safeguards were put in place to ensure that investigators pursuing criminal matters did not obtain warrants under FISA that they could not get from an ordinary judge. After the Sept. 11th attacks, members of the Bush administration were highly critical of the FISA restrictions. Portions of the Patriot Act expanded the law's reach to cover terrorism suspects as well as agents of foreign countries. But when President Bush ordered an expanded program of surveillance by the National Security Agency, he decided to bypass the FISA process entirely. When news of these warrantless wiretaps was revealed by The New York Times in 2005, administration officials argued that working within FISA would have been too cumbersome.

Section 1803 of the FISA established a secret court called the Foreign Intelligence Surveillance Court, which "shall have jurisdiction to hear applications for and grant orders approving electronic surveillance anywhere within the United States under the procedures set forth in this Act." The FISC is comprised of 11 district court judges appointed by the Chief Justice, and a Court of Review, which is comprised of three district court or court of appeals judges appointed by the Chief Justice. Applications for court orders authorizing searches or surveillance under FISA are made to the FISC under oath by a federal officer with the approval of the Attorney General, the Acting Attorney General, or the Deputy Attorney General. 50 U.S.C. §§ 1801(g), 1804, 1823. The application must identify or describe the target of the search or surveillance, and establish that the target is either a "foreign power" or an "agent of a foreign power." 50 U.S.C. §§ 1804(a)(3), 1804(a)(4)(A), 1823(a)(3), 1823(a)(4)(A). A "foreign power" is defined to include, among other things, a "foreign government or any component thereof," and a "group engaged in international terrorism." 50 U.S.C. §§ 1801(a)(1), (4).

    FISA created the Foreign Intelligence Surveillance Court. The court was originally composed of seven district judges, named by the Chief Justice of the US; they served a maximum of seven years. In 2001, the Patriot Act amended FISA to increase the number of judges to 11 and required that at least three of the judges "reside within 20 miles of the District of Columbia."
