Abstract:
The language of international human rights has become a platform for organizing the international indigenous movement. Its emancipatory rhetoric has enabled indigenous peoples to claim legitimacy for their struggles against states. Speaking the language of rights has served the purpose of consciousness-raising of indigenous issues among governments and the public around the world. This rights-based strategy has also had indirect effects within the groups themselves. In this paper, I describe the consciousness-raising that is occurring within indigenous groups as they appeal to international law. I focus on the campaign of the Pimicikamak Cree Nation of Manitoba, Canada. I demonstrate that popular mobilization has been accompanied by both a revival of “customary” law and practices and an intra-group negotiation over the meaning of “custom.” Convention Convention is an application service for managing large or small academic conferences, annual meetings, and other types of events!

image by Jan Oskar Engene, 5 December 1998 A colleague returned recently from an assignment in Guatemala and brought with him a photograph of a flag which was presented to him as the flag of the Mayas. The Maya flag is divided diagonally into four fields, the one closest to the hoist is white (for peace), the field in the fly end is yellow (for the sun), the top field is blue (for the sky) and the bottom field is red (for fire). The flag was fringed in light blue. The photographed flag also had a red stripe at the hoist, but this seems to be a sleeve for hoisting. My colleague was explained that these flags are not for sale in shops, so they are all home made. I don't know what the status of the flag is or anything about its history.

Indigenous Peoples’ Consultation on the Right to Food: A Global Consultation Atitlán, Sololá, Guatemala, April 17 - 19, 2002 We, representatives and traditional authorities of Indigenous Peoples, Nations, and organizations from 28 countries, gathered from all regions of the world, including farmers, hunters, gatherers, fishers, herders, and pastoralists, met in Panajachel, Sololá, at Lake Atitlán, Guatemala, on April 17–19, 2002, with the following objectives: To learn about the hardships faced by Indigenous Peoples in food-related matters. To define common elements among Indigenous Peoples: To propose them to the States so that the States will implement the Right to Food in accordance with the aspirations of Indigenous Peoples; and, To strengthen ties of cooperation among Indigenous Peoples. To formulate a strategy based on the vision of Indigenous Peoples, with the objective of making proposals to the States and to the international community in order to overcome hardships in matters of Food Security and Food Sovereignty. We extend our deep appreciation to the Indigenous Peoples of Guatemala, particularly the Maya Kaqchikel People for their hospitality and generosity in hosting the various delegations attending this consultation.

    The United Nations just released its dense but highly informative report. Throughout the report, the UN reiterates the fundamental importance of providing greater educational opportunities to indigenous children. For those without the time to hunker down and read all 250 pages of the report, here are a few excerpts that pertain specifically to Guatemala and education. The World Bank has reported that “the rate of stunting [height/age] for Guatemala overall is 44 percent, but for indigenous children the rate is 58 percent, higher than either Yemen or Bangladesh, and almost twice the rate for non-indigenous children. From 1998 to 2002, IMADR had been working with Youth Movement for Peace (Movimiento de Jovenes Para la Paz, MJP) based in Quetzaltenango to empower indigenous Mayan communities in Solola and San Marcos, rural communities is Guatemala, so they can actively participate in the peace process. This is carried out by increasing awareness of the Peace Agreements and peace process, enhancing the level of basic education available to allow more active participation in all spheres of life and decision-making, and developing youth leadership in the Mayan communities. From 2002 to 2006, IMADR supported the creation and operation of a community radio for Mayan communities, after it was proposed by MJP and the youth in Bocacosta. edit The home of Nobel Peace Prize winner Rigoberta Menchu, Guatemala saw an end to a 36-year old civil war in December 1996. During the civil war, indigenous peoples suffered the most from human rights violations and massacres. The Peace Agreements guarantee the protection of the rights of indigenous peoples, who in Guatemala comprise a a large proportion of the population, but it has not been easy to overcome the discrimination against indigenous peoples having lived through 500 years of oppression after the Spanish invasion of America. Today, many indigenous peoples are fighting poverty and discrimination to build a true democratic, peaceful Guatemalan society. But the execution of the Peace Agreements is slow, and instead activists seeking to reveal the truth of the massacres during the war and promote indigenous peoples' rights are being threatened and murdered for their actions.

I find it unbelievable that at the same time UNICEF was reporting a 50% chronic malnutrition rate among indigenous children in Guatemala, it was lobbying hard to shut down international adoptions.  UNICEF has now stepped away from working with Guatemala to improve the proposed system.
