Health Law
For the United Nations, the rule of law refers to a principle of governance in which all persons, institutions and entities, public and private, including the State itself, are accountable to laws that are publicly promulgated, equally enforced and independently adjudicated, and which are consistent with international human rights norms and standards. What is Health law? Health law refers to a statute, ordinance or code that prescribes sanitary standards and regulations for the purpose of promoting and preserving the community's health. (Black's Law Dictionary, 8th ed. 2004) Public health law concerns the legal powers and duties of the state to assure the conditions for people to be healthy (e.g., to identify, prevent, and ameliorate risks to health in the population) and the limitations on the power of the state to constrain the autonomy, privacy, liberty, proprietary, or other legally protected interests of individuals for the protection or promotion of community health. (Gostin, L: Public Health Law: Power, Duty, Restraint, 1st ed. 2000) The role of the Health Law team is:

Health Law Concentration
The NSU Law Center offers a concentration in Health Law, permitting students to obtain recognition for their concentration in health-law-related studies. Completion of the requirements for this concentration will lead to a notation on the qualified student's transcript and a certificate indicating the student's focus, interest and specialized training in this area. To earn a concentration in Health Law, each student must complete the course, credit, writing and service requirements described below. These requirements may not be waived.
  • Certification Form
  • 1. COURSE AND CREDIT REQUIREMENTS All students must: (1) complete at least 16 credit hours in approved courses, as listed below, and (2) receive at least a grade of "C" or a "pass" for each credit that counts toward the concentration. All students must successfully complete each of the following courses:
    • Administrative Law Health Law
    In addition, all students must successfully complete at least four courses from the following list of courses. Credit hours must total at least 16.*

    The membership of the Health Law Section consists of those in legal practice devoted to dealing with the administration of health care. The section has been active in the continuing legal education field, including co-sponsorship of an annual health law legislative update with The Virginia Bar Association and the Virginia Hospital Association.
