    Two More DME Owners in Miami Arrested for Health Care Fraud
    An investigation coordinated by the U.S. Department of Justice Medicare Fraud Strike Force, supervised by the Criminal Division’s Fraud Section and the U.S. Attorney’s Office for the Southern District of Miami has resulted in the arrest of Emilio Felipe Lopez, 47, and Orlando Hernandez Estevez, 25, both of Miami-Dade County. The arrests by federal agents stem from two separate indictments charging Estevez and Lopez with health care fraud, in violation of Title 18, United States Code, Section 1347. According to the indictment, Emilio Felipe Lopez was the president of Charlie RX, Inc., a DME business operating in Hialeah, Florida. The indictment alleges that Charlie RX submitted $689,853 in false claims to Medicare for, among other items - are you ready for this one - male vacuum erection systems for female patients! The company received $370,838 from in Medicare based upon its false billings. According to a separate indictment returned in March 2010, Orlando Hernandez Estevez was the president of Happy Trips of Miami, Corp., another DME business operating in Hialeah, Florida. The indictment alleges that Happy Trips submitted $1,188,956 in false claims to Medicare for inhalation drugs. The company received $364,120 from Medicare based upon the false billings.

Improvements in technology and medical care have increased life expectancy by a considerable amount. Alongside these improvements, health care costs have risen dramatically. Because the health of the people in a nation reflects the health of the nation itself, health care law is vital for the stability of the United States. Preserving public health is a primary duty of the state. Health regulations and laws are therefore almost all state based. Many states delegate authority to subordinate govermental agencies such as boards of health. These boards are created by legislative acts. Federal health law focuses on the activity of the Department of Health and Human Services (HHS). It administers a wide variety of agencies and programs, like providing financial assistance to needy individuals; conducting medical and scientific research; providing health care and advocacy services; and enforcing laws and regulations related to human services. An important part of the HHS are the Centers for Medicare and Medicaid Services , which oversee the Medicare and Medicaid Programs. Their goal is to ensure that elderly and needy individuals receive proper medical care.

    Housed within the School of Public Health's Department of Health Policy , The Hirsh Health Law and Policy Program offers unique educational opportunities to law students and practicing lawyers alike. Established in 1997 and endowed by Harold and Jane Hirsh , the Hirsh Program fosters an interdisciplinary approach to the study of health law, health policy, health care, and public health. With consideration of Health Policy's evolving role , the program's overall goal is to advance a greater understanding regarding how the law influences and shapes all phases of health care and public health, as well as how the changing system affects traditional areas of the law. At the same time, the program seeks to achieve the pragmatic objectives of readying law degree candidates and practicing lawyers for the broad range of health law-related careers available today.
