The bad mortgages that got the current financial crisis started have produced a terrifying wave of home foreclosures. Unless the foreclosure surge eases, even the most extravagant federal stimulus spending won't spur an economic recovery. So far the industry hasn't shown that kind of foresight. One reason foreclosures are so rampant is that banks and their advocates in Washington have delayed, diluted, and obstructed attempts to address the problem. Industry lobbyists are still at it today, working overtime to whittle down legislation backed by President Obama that would give bankruptcy courts the authority to shrink mortgage debt. Lobbyists say they will fight to restrict the types of loans the bankruptcy proposal covers and new powers granted to judges.

When we ran the 2008 version of the Most and Least Affordable Housing Markets in the U.S. , the housing downturn was already well under way but the economy had yet to be rocked by the financial meltdown brought on by the collapse of Lehman Brothers. Since then housing continued to decline as foreclosures rose and unemployment deepened. Not surprisingly, the industrial heartland of America, much of it largely dependent on the struggling automotive sector, has been hardest hit. That explains why states such as Indiana, Michigan, and Ohio are home to the nation's most affordable housing markets. The winner? Kokomo, Ind. The nation's least affordable? No surprise there: the area around New York City.

"John Ashcroft said he was going to uphold the law. The issue is whether he is going to be consistent. I don't think he will be," adds Robinson, referring to the Attorney General's promise in March to uphold the the policies being challenged by Adarand Constructors. LOWEST BID. Adarand, a white-owned construction company in Colorado Springs, failed to win a contract for erecting roadside guard-rails in Colorado's San Juan National Forest after submitting the lowest bid. It argues that special treatment for minority firms by the U.S. Transportation Dept. amounts to reverse discrimination. So far, there has been no word on the issue from the White House. "The silence from the Bush Administration is deafening," says Steven Sims, a vice-president at the National Minority Supplier Development Council (NMSDC), a non-profit, corporate-financed organization that recruits and certifies minority-owned companies. The Small Business Administration, which runs programs to help minority-owned companies compete for federal contracts, isn't talking. "The issue is too politically charged for us to speak at this point," says SBA spokeswoman Tiffani Clements. At the Justice Dept., spokeswoman Cristine Romano was no more forthcoming, saying: "We're not ready to talk to the public." The department will be filing a brief in the case later this spring, but what it will say remains a mystery for now. "The department has filed documents in the past, and now we have a new Administration that's reviewing those and hasn't come to any conclusions," says Romano, referring to briefs that were filed in the Adarand case during the Clinton Administration.

They are "flippers," here for the daily outdoor auction of foreclosed homes — bidding for themselves or clients who plan to buy houses cheaply and fix them up for a quick sale. And with the economy starting to percolate and real estate markets bottoming out, the auctions are drawing bigger crowds. "A year ago, bums outnumbered bidders at the courthouse steps," says Sergio Rodriguez, who bought and sold 48 properties last year even as falling home values scared other investors away. Thousands of subprime mortgage lenders and brokers — many of them the very sorts of firms that helped create the current financial crisis — are going strong. Their new strategy: taking advantage of a long-standing federal program designed to encourage homeownership by insuring mortgages for buyers of modest means. You read that correctly. Some of the same people who propelled us toward the housing market calamity are now seeking to profit by exploiting billions in federally insured mortgages. Washington, meanwhile, has vastly expanded the availability of such taxpayer-backed loans as part of the emergency campaign to rescue the country's swooning economy. For generations, these loans, backed by the Federal Housing Administration, have offered working-class families a legitimate means to purchase their own homes. But now there's a severe danger that aggressive lenders and brokers schooled in the rash ways of the subprime industry will overwhelm the FHA with loans for people unlikely to make their payments. Exacerbating matters, FHA officials seem oblivious to what's happening — or incapable of stopping it. They're giving mortgage firms licenses to dole out 100 percent-insured loans despite lender records blotted by state sanctions, bankruptcy filings, civil lawsuits, and even criminal convictions.
