by Charles McDowell For some reason that completely escapes me, most people cheer from the sidelines when the SEC has upstanding businessmen handcuffed and hauled away for the so-called crime of insider trading . Why is this? Given that there is nobody who can claim to be the victim of insider trading, all I can figure is that they cheer out of jealousy and resentment. According to the SEC, insider trading is the act of buying or selling a security while in possession of relevant, "nonpublic" information about that security. A person is also in violation if they "tip" this nonpublic information, whatever that means. First of all, the law is ambiguous and necessarily arbitrary. What is "nonpublic" information and what is "tipping"? If I have a web site with 100 members and I provide some information, is that "tipping," or is the information now public? How about 1000 members? 10,000? What if the site is CNN.com? Certainly, nobody has

NEW YORK (CNN/Money) - As she faces possible jail time, Martha Stewart invoked the name of Nelson Mandela, South Africa's persecuted anti-apartheid hero, saying "many, many good people have gone to prison." Her declaration came in a TV interview taped hours after the homemaking diva was sentenced to five months in prison and two years' probation Friday for lying to investigators about her sale of ImClone Systems stock in late 2001. Federal Judge Miriam Goldman Cedarbaum also ordered Stewart to serve five months of home confinement after her release and fined the lifestyle expert $30,000. The sentence was the minimum the judge could impose under federal sentencing guidelines. The fine, while relatively small given Stewart's wealth, was the maximum allowed under federal rules.

insider trading: an overview
Insider trading refers to the trading of a company’s stocks or other securities by individuals with access to confidential or non-public information. Taking advantage of this privileged access is considered a breach of the individual’s fiduciary duty. The United States requires that a company report trading by corporate officers, directors, or other company members with significant access to privileged information to the Securities and Exchange Commission or be publicly disclosed. United States federal law defines an “insider” as a company’s officers, directors, or someone in control of at least 10% of a company’s equity securities. Congress has criminalized these insiders’ use of non-public information under the theory that the use fraudulently violates a fiduciary duty with which the company has charged the insider. From an economic public policy perspective, scholars consider insider trading socially undesirable because it increases the cost of capital for securities traders and therefore depresses economic growth. The Insider Trading Sanction Act of 1984 and the Insider Trading and Securities Exchange Act of 1988 provide for insider trading penalties to surpass three times the profits gained from the trade.

Republicans spent $40 million to investigate the Clintons and this
"stock trade" and all they came up with was a blow job.
No...what ultimated resulted in were a slew of indicments and a Presidential Impeachment. And about that blow job...he lied...while being questioned as the result of a sexual harrassment suit. Damndest thing about context isn't it?
Do you harrangue everyone who says what you say or do you have a selection criterion?
The only crime that the $40 million of taxpayer money came up with is that Bill lied about a blow job. He admitted it - was impeached - and disbarred for "lying about a blow job."

    1) By lifting the ban on short sales on down ticks they gave the "green light" to "Bear Raiders", the bane of the early 1930s until legislation banned short selling
    on down-ticks. 2) By not enforcing rules that require short sellers to borrow the stock they sell short, they have given Bear Raiders access to all the stock they want. 3) SEC Chairman Cox LIED on CNBC when he said naked short selling was not illegal. He has now chosen to enforce it selectively. 4) When 3 days ago, they banned naked short sales in key bank stocks, the reaction was immediate. Some bank stocks have risen more than 50% in the three days since, 5.) Look at the high volume in finance stocks.     I have no ill will towards kitschy craft diva Martha Stewart and this CBS sequel to Martha, Inc.: The Story of Martha Stewart (2003) didn't change my opinion. Cybill Shepherd reprises her role as the shrewd business woman who's cover up of an insider trading crime lands her a 5 month stint in a minimum security prison. Written from the facts with no artistic liberties or dirt exposed, this plays like a miscast episode of Dragnet. Only a third of the film takes place behind bars and these scenes are as light as Martha's Lemon-Chamomile Cream Pie. We are treated to such thrilling scenes as Martha busted with spices and Martha joining an inmate christmas decoration contest. "Yawn." Minimal effort is put into what makes Martha tick and there is no clear character arch to make the production rise above typical tele biopic fare. Do yourself a favour and watch the real Martha Stewart make Bacon Cheeseburgers instead
