The USPTO Enhanced Examination Timing Control Initiative: Part 1

Maier on November 12, 2010 4:30 PM No Comments No TrackBacks Earlier this year, USPTO Director David Kappos proposed a three-track program initiative, intended to meet the Patent and Trademark Office's strategic goal of reducing patent pendency and backlogs. The proposal, officially entitled the Enhanced Examination Timing Control Initiative, will provide patent applicants with three pathways, or tracks, for examination of patent applications, with each track having its own timeline, costs and requirements.
Track 1 of the program would have a prioritized examination timeline. The goals in Track 1 include sending out a first Office Action on the merits within four months of the request for prioritized examination, and a final action either a Final Rejection or Allowance within 12 months of the request.
Track 2 would essentially be analogous to the current examination process. Presently, the examination process takes an average of 34 months from filing to final action. However, the USPTO expects that, once the three-track program is implemented, application pendency would be reduced, with an expected timeline of 10 months until the first Office Action, and a final action within 20 months.
Track 3 would allow non-continuing applications that are first filed at the USPTO up to 30 months from the priority date to decide whether to request examination. The applicants would thus be able to defer examination of, or "park," their applications for that time period. The request to park an application may be made either upon filing or in a reply to a notice of missing parts. However, parked applications would still be published 18 months from the priority date, as under the present system.
