This website focuses on the challenge of politics and policies with regard to development and potential conflict in water scarce environments in the Middle East.
Information is organised on three main topics: the impact of water on politics in the Jordan river basin , a broader view on water issues in the Middle East and more general international aspects of water resources and policies
Introduction: water, conflict and development
In March 2005, we entered the 'International Decade on Water and Development'.
This decade was proclaimed by the United Nations to focus international attention on the Millennium Development Goals. More specificly, it calls for special action on the goal for water: by 2015, the population which has no sustainable access to safe water resources must be halved. In the Middle East, attention seems not primarily focused on issues concerning the link between water and poverty reduction. This region is more associated with 'water conflicts' and 'rivers of fire', images that media are eager to adopt. Put like this, it is suggested that the main problems with water in the Middle East are related to tensions among countries generated by water scarce environments. Water is presented as a security issue that divides communities, not as a leverage for development that brings communities together. On the face of it, violent interstate competition over water resources doesn't seem so strange in the context of ongoing political tensions in the Middle East. Why can water scarcity not spark the fire of the Israeli-Arab conflict, or the susicions towards Turkey, Saoudi Arabia or Iran? However, many observers tend to say that the likelyhood of water wars needs to be moderated.

      The Editors of MJIL invite submissions on areas of interest in international law for the first issue of their 12th volume, to be published in May 2011. MJIL publishes articles, commentaries, case notes and book reviews. Articles should be in the vicinity of 10 000 to 20 000 words in length and be an original and detailed contribution to international law scholarship. Commentaries explore recent developments in a specific field of international law and their practical applications, and should be between 5000 and 8000 words in length.

    From Wikipedia, the free encyclopedia Jump to: navigation search Sources of international law are the materials and processes out of which the rules and principles regulating the international community are developed. They have been influenced by a range of political and legal theories . During the 19th century, it was recognised by legal positivists that a sovereign could limit its authority to act by consenting to an agreement according to the principle pacta sunt servanda . This consensual view of international law was reflected in the 1920 Statute of the Permanent Court of International Justice , and preserved in Article 38(1) of the 1946 Statute of the International Court of Justice Article 38(1) is generally recognised as a definitive statement of the sources of international law. It requires the Court to apply, among other things, (a) international conventions "expressly recognized by the contesting states", and (b) "international custom, as evidence of a general practice accepted as law". To avoid the possibility of non liquet , sub-paragraph (c) added the requirement that the general principles applied by the Court were those that had been "the general principles of the law recognized by civilized nations". As it is states that by consent determine the content of international law, sub-paragraph (d) acknowledges that the Court is entitled to refer to "

      Featuring Keynote Speaker Paul Weisenfeld , senior deputy assistant administrator for the U.S. Agency for International Development's (USAID) Latin American/Caribbean region, who led the agency's response to the Haiti earthquake as coordinator of USAID's Haiti task team. The Emory International Law Review and Emory Center for International and Comparative Law are pleased to bring an accomplished group of disaster law experts to campus on January 27, 2011 to discuss the international community's response to such catastrophic events as the Haiti earthquake, Pakistan floods, and Indian Ocean tsunami. The daylong symposium, beginning at 9 a.m. at Emory Law's Tull Auditorium, will analyze how nations can balance the need for receiving timely assistance from worldwide organizations with their goal of retaining sovereignty in the days following a disaster. As countries struggle to rebuild, is it appropriate for international law to play a role in managing the chaos? Panelists, who have visited and assisted in many disaster zones, will debate new disaster preparedness guidelines and the policy implications of having the international community assume a more prominent role in disaster relief. Some panelists will focus their remarks on specific aspects of disaster law, such as how the tragic events impact housing rights, children, healthcare, and education.

      Complementarity

Stout, Reporter, International Judicial Monitor General Principle The establishment of international criminal tribunals creates the problem of coordinating their action with that of national courts. This problem is manifest when both international and national courts are empowered to prosecute the same crimes. Deciding which courts take precedence raises difficult questions of sovereignty and international relations. Clear guiding principles are necessary to resolve the delicate issue of whether an international or national court takes priority in given case. The principle of complementarity provides such guidance. The principle of complementarity embodies the concept that a court may only assert jurisdiction over a case that another court has not already investigated or prosecuted. The subsidiary court generally enjoys priority in the exercise of jurisdiction over a case, and the chief court only exercises its complementary jurisdiction in exceptional circumstances. In international law, the concept of complementarity primarily applies in the context of the exercise of jurisdiction by the International Criminal Court.
