Arizona Immigration Law Temporarily Blocked
Thu, 07/29/2010 - 18:47 — sciencestaff Yesterday, in the lawsuit brought against Arizona by the Justice Department, US District Judge Susan R. Bolton ruled that several key provisions in Arizona’s controversial immigration law (SB1070) would interfere with federal law and policy. Her ruling temporarily blocks provisions that would require police to determine the immigration status of anyone they stop, detain or arrest; criminalize failure to apply for or carry alien registration papers; and allow the warrantless arrest of someone who might be subject to deportation. Although the ruling is not final, it is a good indication that the federal government is likely to win the case.
The AAA has already passed a resolution condemning SB1070, calling the law “predatory and unconstitutional.” The association will not hold any scholarly meetings in Arizona, except on Indian reservations, until the law is repealed or struck down.

According to the Bureau, "At yearend 2006 Federal and State correctional authorities had jurisdiction over 1,570,861 prisoners, an increase of 2.8% since yearend 2005.1 The Federal system held 12.3% of these prisoners, and States held the remaining 87.7%. The number of prisoners under Federal jurisdiction increased by 5,428 prisoners, and the number under State jurisdiction increased by 37,504 prisoners." The Bureau reported that "At yearend 2004 (the most recent data available for estimating offense distributions by gender and race) more than half (52%) of all sentenced inmates in State prisons were sentenced for a violent offense (table 11) (See Appendix tables 9 and 10). Property offenses were the most serious charge for 21% of State prisoners, and drug offenses, 20%." They also reported that "On September 30, 2006, (the latest available data from the Federal Justice Statistics Program on offenses of Federal prisoners) drug, weapons, and immigration offenders made up more than three-quarters (78%) of the 176,268 sentenced Federal prison population (table 12). Drug offenders made up more than half (53%); weapons offenders, 14%; and immigration offenders, 11%."

Home Library US Government Guide Although the post of attorney general dates back to George Washington's first cabinet, Congress did not establish the Department of Justice until 1870. The department represents the United States in court, enforces federal laws, and supervises federal prisons. Its head, the attorney general, is the nation's top law-enforcement officer. Within the Department of Justice, the Antitrust, Tax, and Civil Rights Divisions handle cases involving violations of federal laws in their specific areas. The Criminal Division handles court cases involving federal crimes not covered by the other divisions. The Environment and Natural ReSources Division handles criminal and civil cases involving public lands and natural reSources. The Civil Division handles other civil cases to which the United States is a party. When cases involving the U.S. government reach the U.S. Supreme Court, the solicitor general represents the nation. A top official in the Department of Justice, the solicitor general decides which lower court decisions the federal government will appeal to the highest court as well as what positions the government will take in those appeals. The solicitor general often argues these cases personally before the Supreme Court.

Illegal alien incarceration bad for states' budgets

President Barack Obama says he wants lawmakers in both houses of Congress to make progress this year on reforming the immigration system. However, he's not talking about how his administration is failing to protect citizens from criminal aliens.
When the United States incarcerates criminal aliens non-citizens convicted of crimes while in this country legally or illegally in federal and state prisons and local jails, the federal government bears only a small part of the costs.
While the federal government pays to incarcerate criminal aliens in federal prisons, it reimburses state and local governments such as Arizona for a mere portion of their costs of incarcerating some, but not all, criminal aliens illegally in the country through the Department of Justice's State Criminal Alien Assistance Program managed by the Bureau of Justice Assistance.
Some state and local governments have expressed concerns about the impact that criminal aliens have on already overcrowded prisons and jails and that the federal government reimburses them for only a portion of their costs of incarcerating criminal aliens. Congress requested that the General Accounting Office provide information concerning criminal aliens incarcerated at the federal, state, and local level. For the criminal aliens incarcerated, the state and local governments that received reimbursement through SCAAP, only received about 25 percent of the costs .

    Gang Centers Merge
    In October 2009, the National Youth Gang Center, which had been funded by the Office of Juvenile Justice and Delinquency Prevention since 1995, merged with the National Gang Center (NGC), which had been funded by the Bureau of Justice Assistance since 2003. This new partnership, the National Gang Center , recognizes that street gang activities transcend ages of the members and that a balanced, comprehensive approach is needed to reduce gang involvement and levels of gang crime. Consolidation of the centers has leveraged resources and resulted in a single, more efficient entity, responsive to the needs of researchers, practitioners, and the public. The new Web site, www.nationalgangcenter.gov , features the latest research about gangs; descriptions of evidence-based, anti-gang programs; and links to tools, databases, and other resources to assist in developing and implementing effective community-based gang prevention, intervention, and suppression strategies. Here you will find an analysis of the findings from nearly 15 years of data collected by the annual National Youth Gang Survey of 2,500 U.S. law enforcement agencies. Visitors can read and download publications related to street gangs. An online form allows communities to request training and technical assistance as they plan and implement anti-gang strategies. Users can register for a variety of anti-gang training courses. The Web site also hosts a database of gang-related state legislation and municipal codes; a list of newspaper articles on nationwide gang activity that is updated daily; and GANGINFO, an electronic mailing list for professionals working with gangs.
