AFTEREFFECTS: INTELLIGENCE OPERATIONS; JUSTICE DEPT. LISTS USE OF NEW POWER TO FIGHT TERROR
By ERIC LICHTBLAU Published: May 21, 2003 WASHINGTON, May 20 — In the most detailed public accounting of how it had used its expanded powers to fight terrorism, the Justice Department released information today showing that federal agents had conducted hundreds of bugging and surveillance operations and visited numerous libraries and mosques using new law enforcement tools. In one of the more striking examples of their new powers, Justice Department officials said they were now reviewing some 4,500 intelligence files in terrorist cases to determine whether criminal charges should be brought. Such a mingling of intelligence and criminal investigations was largely banned under internal Justice Department procedures that were in place before the terrorist attacks of Sept. 11, 2001. A 60-page report to members of Congress was intended to answer concerns from lawmakers who say the department has kept them in the dark about its counterterrorism operations and has not done enough to safeguard civil liberties in its pursuit of terrorists. The report provided dozens of pieces of previously undisclosed data on a variety of activities including the use of hundreds of secret search warrants and the fact that some 50 people had been detained without charges as material witnesses.

AFTER THE ATTACKS: THE INVESTIGATION; Justice Dept. Identifies 19 Men as Suspected Hijackers
By NEIL A. LEWIS and DAVID JOHNSTON Published: September 15, 2001 WASHINGTON, Sept. 14 — Justice Department officials today disclosed the names of 19 men who they said had commandeered four commercial jets in Tuesday's terror attacks, and the officials said they wanted to question more than 100 other people who are associated with the hijackers. Several of the 19 men identified by federal officials as those who carried out the suicide missions lived in Florida or at least had recent Florida addresses. Others were listed as having lived in New Jersey, California, Massachusetts and Arizona. In New York City today, the authorities arrested an unidentified associate of Osama bin Laden's brother, government officials said. The man is suspected of having information about plans for the attack and was arrested on a sealed material witness warrant obtained by federal prosecutors in Manhattan. The arrest was the first directly connected to the terror plot. Arrests on material witness warrants are usually issued when the authorities believe someone has information about a crime, but may not have themselves broken the law or to place people in custody who are considered flight risks.

Supreme Court invalidates Southern California Diesel Ban 28 April 2004 The US Supreme Court ruled today that the federal Clean Air Act prohibits the South Coast Air Quality Management District (SCAQMD) regulations that ban the purchase of diesel vehicles by fleet operators. This 8:1 ruling was a victory for the industry coalition of Engine Manufacturers Association (EMA) and the Western States Petroleum Association (WSPA). regulations that required operators of fleets of 15 or more vehicles to purchase alternative fueled (such as natural gas) vehicles. The regulations effectively banned the purchase of diesels (including emission-controlled diesels of emissions equal or cleaner to those from natural gas vehicles). REBUTTAL: Buddy Lamont
The Government command post Red Arrow reached Wounded Knee Security by radio stating that they were honoring an agreed upon cease fire, but that their Roadblock-6 was "still receiving fire". Wounded Knee security answered that they were still taking almost continuous automatic weapon fire" from a hill near roadblock-6. Red Arrow answered: "Ten-four. A couple of our RBs [roadblocks] have reported firing and they don't know who is over in those positions. They report that it is being fired into Wounded Knee." WOUNDED KNEE: "You're pretty sure we have a third party out there firing on us with automatic weapons?"
RED ARROW: " That's what it sounds like." The vigilantes were in the hills with government issued automatic weapons, M-16s, firing on both government and Indian postions. . The marshals began using M-79 gas grenades to clear the bunkers. Gas forced the two out gasping for breath..as he emerged, Buddy Lamont was hit with a burst of M-16 fire. Because of the heavy fire, medics were unable to reach him for three hours, at which time the government agreed to a cease fire and medics recovered his lifeless body. Buddy Lamont became the second fatality of Wounded Knee. REBUTTAL: PEDRO BISSONETTE
Throughout the summer of 73 WKLO/DC were kept busy preparing hundreds of defense cases (11 people received felony convictions, 4 received misdemeanor..the rest were released) as a result of WKII. Pedro Bissonette's bail had been set at 150,000$. Lane, Lakota Attorney, Ramon Robideaux, and California attorney Marge Buckley had been barred from seeing their client. According to Buckley, she, Lane and Roubideaux were ordered to leave after being told "only court appointed attorneys could get in". The judge confirmed in a yelling match in the hallway that it had been his orders. While in jail, Pedro's court appointed attorney had brought to him the government's deal; if he agreed to turn state's evidence, to testify against AIM leaders on conspiracy charges stemming from Wounded Knee, he would be offered probation on his own charges. If he refused, he was looking at a 90 year sentence..
