2010 Bankruptcy Filings Increased Almost 14% Over 2009
The sad statistics are in from the federal courts , and the bad news is that bankruptcy filings were up almost 14% over 2009. The highest increases were seen in non-business bankruptcies, with press release contains a lot of links to different tables that analyze the data. Cuyahoga County DR Fees Will Increase Effective December 1, 2010
The Cuyahoga County Domestic Relations Court is increasing its fees on December 1, 2010: "The Court has revised Local Rule 1 pertaining to Security for Cost effective December 1, 2010.  Under the new rule the advance deposit will increase from $250.00 to $300.00 when a contested divorce is filed where there are children.  Deposits will increase from $100.00 to $200.00 when requests involving parenting modifications or changes to shared parenting plans are filed.  The deposit for filing other post-decree motions will increase from $45.00 to $50.00." How I wish I could turn back the clock so that I could get up and leave. (It's worth recalling, by the way, that Senator Russ Feingold opposed Bybee's nomination on the ground that the Administration had refused to make available the legal memoranda that Bybee prepared while at OLC. How prescient that objection now seems...)

Can You Really Get Three Months In Jail For Five Firecrackers?
You can put your eyeballs back in their sockets. You read it right: 3 months in the slammer (and a fine of about $600!) for possessing 5 firecrackers. From the New Straits Times (Malaysia): A jobless man was sentenced to three months' jail and fined RM2,000 by the magistrate's court yesterday for possessing five firecrackers. Mohd Zafizie Mohd Zawawi, 29, pleaded guilty to committing the offence at Gate J of Sultan Mohamed IV Stadium at 9pm on Saturday. Zafizie, from Kampung Belakang Masjid, who was unrepresented, told magistrate Nik Habri Muhamad neither he nor his parents could afford to pay a high fine. "I have repented and I promise not to commit the offence again. This will be my first and last offence." Krykie! A first offender too. [The magistrate] told Zafizie that he had committed a serious offence because the stadium was a place for recreation.

The Mass Libel Reform Blog - Fight for Free Speech
In common with many other bloggers, I am delighted to host the following at the suggestion of Simon Singh.
This week is the first anniversary of the report Free Speech is Not for Sale, which highlighted the oppressive nature of English libel law. In short, the law is extremely hostile to writers, while being unreasonably friendly towards powerful corporations and individuals who want to silence critics.
The English libel law is particularly dangerous for bloggers, who are generally not backed by publishers, and who can end up being sued in London regardless of where the blog was posted. The internet allows bloggers to reach a global audience, but it also allows the High Court in London to have a global reach.
You can read more about the peculiar and grossly unfair nature of English libel law at the website of the Libel Reform Campaign. You will see that the campaign is not calling for the removal of libel law, but for a libel law that is fair and which would allow writers a reasonable opportunity to express their opinion and then defend it.
The good news is that the British Government has made a commitment to draft a bill that will reform libel, but it is essential that bloggers and their readers send a strong signal to politicians so that they follow through on this promise. Australian Patent Office Creates Uncertainty On Patentability of Business Methods
by Stephen Albainy-Jenei November 11, 2010 The APO has issued a decision which has created uncertainty regarding the patentability of business methods. Until recently, our advice to clients was that business methods were patentable in AU, provided that the claims were limited to execution of the business method in a computer environment The APO has now issued the Iowa Lottery decision in which the Deputy Commissioner of Patents concludes (at para 17) that: I do not believe there is any authority in Australian law for the proposition that the mere identification of a physical effect is sufficient for patentability. (underlining added) The above reference to “ physical effect ” is a reference to the precedential decision of the Full Federal Court in the Grant case.  In 2006, the Full Federal Court concluded in the Grant case ( Grant v. Commissioner of Patents [2006] FCAFC 120 ) that: A physical effect in the sense of a concrete effect or phenomenon or manifestation or transformation is required . In NRDC, an artificial effect was physically created on the land.

This is part two in a two part series relating to social benefits from personal injury lawsuits. Georgian Luger Nodar Kumaritashvili died on February 12, 2010. He should not have. Lawsuits remind people to take the care necessary to make sure they do not injure others. The designer of the luge course and the International Olympic Committee knew in advance how dangerous the course was and still sent relatively inexperienced luge riders down the track. They knew athletes were crashing more often, and at higher speeds than normally occur in the sport. Such dangerous conditions occur because the speed and danger of the track make the event sell better. It makes the race more exciting. It also saves the money that should have been spend on having an engineer review the course to determine how high that safety wall should have been, and the expense of making the course safer, including a higher wall and padding and barricading the steal beams next to the track. Huffington Post blogger Marian Salzman wrote: “With 82 countries participating in the Games this year, shouldn't the course have been designed to be safe for all of them? Where were the safety wardens?”

Alimony Reform and the Business of Divorce
The Boston Business Journal continues to cover the controversy over the competing Massachusetts alimony bills, and in Friday's article by Lisa van der Pool, Dueling alimony bills raise hackles in legal circles , the focus was on the question of whether Senator Cynthia Creem, chair of the Senate's Judiciary Committee, has a "conflict of interest" on account of her sponsorship of the alimony reform bill being heard by her committee, because she is also practicing divorce law in Boston.
Many in the Massachusetts Alimony Reform organization have voiced their belief that she has a conflict of interest. In the article, I was among the quoted legal observers who fail to find any conflict of interest here. And that is so even though I do not support Cynthia Creem's Senate bill, but support instead the much more comprehensive reforms of the House bill. As often happens in the world of family law litigants, logic and reason have become victims to emotion. And once again, I have gone on record to call it like I see it, only to insure I will probably please no one.
