professional responsibility: an overview
The legal profession has existed for over two thousand years.  From the Greek city-states and the Roman Empire to present day United States, legal advocates have played a vital and active role in the formulation and administration of laws.  Because of their role in society and their close involvement in the administration of law, lawyers are subject to special standards, regulation, and liability. Sometimes called legal ethics, sometimes professional responsibility, the topic is perhaps most comprehensively described as the law governing lawyers. Since lawyers are admitted to practice by states this topic is largely one of state law. However, as federal courts can and do set their own practice rules and federal agencies do as well, the topic has a federal component, too. This area of law is covered extensively in the LII's American Legal Ethics Library which includes comprehensive links to primary sources for each U.S. jurisdiction and commentary on the law of lawyering for a growing number of them.

To some, ownership of intellectual property rights in cyberspace simply reflect corporate values that treat virtual space no differently than physical space, where private lots and businesses are protected by walls, fences and gates. This article was excerpted from the book, " Digital Dilemmas: Ethical Issues for Online Media Professionals Robert I. Berkman
Posted: 2003-10-01 Christopher A. Shumway In addition to enabling users to efficiently trade music and movie files, the Internet also allows users to circulate news content, to which they may attach their own comments. By simply cutting and pasting an article from an online news service to a bulletin board and inserting his or her own critique of the reporting, a user can attempt to spur an online conversation. Other readers observing the post may then offer their own comments on the article, or on the first poster's critique, and so on and so on informing, arguing and correcting each other as they go, which is the essence of public debate. So the question arises: Is it ethical to make and distribute copies of news content?

The American Bar Association recently made the rule less restrictive. It permits but does not require lawyers to disclose confidences to prevent, quote, "reasonably certain death or substantial bodily harm." It remains a gray area, and attorneys who obey the confidentiality rule sometimes do so at the expense of innocent people. Lucky Severson reports
