By William M. Shernoff How to Make Your Health and Disability Insurer Pay Your Claim Many insurance companies use "weasel words" in their polices to mislead policyholders about what is covered. Example: In disability cases, most people would regard "house confinement" simply as being ill or disabled enough to have to stay home most of the time. But many insurance companies define "house confinement" as not being able to leave the house at all - not even for doctor's appointments or medically prescribed exercise periods. Fortunately, the courts in states that have bad-faith insurance laws (about 26 states, primarily in the West) usually rule against such a restrictive, self-serving interpretation. It's difficult to interpret a health or disability policy - because the company deliberately wrote it to be as obfuscatory as possible. Courts have held, though, that where the language of an insurance policy is unclear, the language will be construed in your favor and against the insurance company. Stick to your guns if you believe that your interpretation of the policy's language is reasonable. Many courts hold that the reasonable expectations of the policyholder govern the meaning of the policy's language. Most claim denials are based on exclusions - the fine print on the back of the policy that takes away the coverage described on the front of the policy.

Home Resume Publications Health Care Dr. Gruber consulted with Pfizer for 25 years, a time of extraordinary Pfizer progress in the use of information technology-enabled strategic business initiatives. Additional pharmaceutical industry experience includes assignments with the Pharmaceutical Manufacturers and Research Association. Early health industry experience in the 1970s included the development of a computer system for a large chain of nursing homes. He has provided strategy and information consulting services for Harvard University Health Services for over a decade. This assignment led to a referral to the Risk Management Foundation (RMF) of the Harvard Medical Institutions where he was CIO for four years. RMF is the malpractice insurance company for the Harvard-affiliated hospitals and HMOs. Dr. Gruber was a major force in launching an extension of the Risk Management Foundation scope from serving only the Harvard-affiliated medical institutions to a new business venture, funded with venture capital from the Board, to sell information technology-based systems, data and educational services to a worldwide market. In this assignment he assisted in the business planning to justify this venture investment and he was a major player in the sale of the first two clients and the launch of these client assignments. He taught courses in health care economics and management as an adjunct professor in the Boston College Graduate School of Management.

      This column continues my exploration of resources freely available online from remote locations to holders of public library cards with an emphasis on full-text health resources. Last month's column OED Online The Austin Public Library encourages nonresidents to join by comparing the cost to other entertainment purchases. Three months' library access costs $16.75, billed as equivalent to "dinner alone at a nice restaurant." Not in my neighborhood but then again, a quick visit to the Salary Calculator informs me that the cost of living is over 2.5 times higher here in Manhattan than it is in Austin. No wonder everything seems so expensive! My "best of the best" list will appear as the finale to this series of reports.
