  • Choosing mediation to settle a dispute does not result in a loss of any legal rights. If a dispute may not be settled through mediation, each party may continue to seek relief through proper court procedures.
  • Benefits
  • Mediation allows parties to reach their own solutions to disputes. The mediator acts more as a referee, and is not allowed to take sides or impose decisions. Mediation can be less expensive than disputes that are settled by the court system.

    How Mediation Works
    A mediator does not have the authority to make a decision; he or she is there to help the people involved work toward their own agreement. Mediation focuses on identifying issues and solving problems, not determining who is right or wrong. Each party has the chance to make statements and then have a joint discussion. There is also time for individual conversations with the mediator to discuss the case. Joint negotiation may then take place and, if a solution has been reached, the mediation is concluded. If the parties do not reach an agreement, the mediator can suggest further mediation, arbitration or going to trial.
