GOVERNMENT AND POLITICAL CONDITIONS
Namibia is a multiparty, multiracial democracy, with a president who is elected for 5-year term. The constitution establishes a bicameral Parliament and provides for general elections every 5 years and regional elections every 6 years. Members of the 72-seat National Assembly are elected on a party list system on a proportional basis. Members of the 26-seat National Council are elected from within popularly elected Regional Councils. The three branches of government are subject to checks and balances, and provision is made for judicial review. The judicial structure in Namibia largely parallels that of South Africa and comprises a Supreme Court, the High Court, and lower courts. Roman-Dutch law has been the common law of the territory since 1919. Namibia's unitary government is currently in the process of decentralization.
The constitution provides for the private ownership of property and for human rights protections, and states that Namibia should have a mixed economy and encourage foreign investment.

    (IRIN) NAMIBIA: Government spurns AIDS programme Integrated Regional Information Networks - May 18, 1999 JOHANNESBURG, 18 May (IRIN) - The Namibian health ministry has refused to participate in a US $100 million AIDS prevention programme funded by a multinational pharmaceutical company, according to news reports. The programme, 'Secure The Future: Care and Support for Women and Children With AIDS', aims to expand medical research focusing on women and children and to improve community outreach over the next five years. The project was launched in Johannesburg last week and is aimed at Namibia, Botswana Swaziland Lesotho and South Africa . A representative of the pharmaceutical company told IRIN the Namibian health ministry was not represented at the Johannesburg meeting. 'The Namibian' newspaper quoted a health ministry official as saying: "We have just launched our own National AIDS Coordination Programme and we are very committed to it." However, non-governmental organisations (NGOs) involved in the HIV/AIDS sector were quoted as saying the government's programme, inaugurated in 1990, has had very little impact on the prevention of the spread of HIV.

    After the Independence of Namibia in the year 1990, Dr. Sam Nujoma, head of SWAPO - South West African People's Organisation - became the first President of the new state. SWAPO had led the Guerilla war against the South African Apartheid regime, which had persued a policy of racial segregation and discrimination. Namibia's independence was demonstrated with free elections in the year 1989. For the first time, the black majority had the right to vote. SWAPO came off at these elections as the strongest political power in the country. The Constitutional Assembly elected Sam Nujoma in unison as State President. In the second free elections in 1994, SWAPO reached a two-third majority and President Sam Nujoma was confirmed into office and after a change in the constitution, he was elected State President for the third time in 1999. In 2005, Hifikepunye Lucas Pohamba succeeded him in the office. The members of the parliament are elected every five years. In the elections of 1999 the governing SWAPO gained 55 of the 72 seats. As in South Africa, the opposition parties are politically weak and hardly relevant. The DTA (Democratic Turnhallen Alliance), the main party of the white minority, holds only 7 seats. Also the CoD (Congress of Democrats), founded in 1998, with its charismatic leader Ben Ulenga could secure only 7 seats in 1999. All the opposition groups together hold 17 seats.
