To safeguard those affected by the business of insurance through the fulfillment of our statutory obligations and by promoting the fair and just treatment of all parties to insurance transactions.
Statutory Authority for the Department of Insurance
The Department of Insurance was created by Article 12, Section 1, of the Constitution of the State of Nebraska. The Department's general powers are granted by State Statute Section 44-101.01 R.R.S. 1943. The Department's duties and responsibilities are defined in State Statute Chapters 8, 11, 21, 44, 48, 59, 77, 81, and 84.
Responsibilities of the Department of Insurance
The Department of Insurance regulates and examines all insurance companies and certain related operations doing business in Nebraska. Regulation includes: agent licensing and examination; foreign insurer admittance; periodic examination of company affairs; automobile, property, and liability rate approval; policy form approval; rating and claims practice investigation; and complaints investigations. The Department also administers the Excess Liability Fund and supervises the Residual Malpractice Insurance Authority, both of which were established by the Hospital-Medical Liability Act of 1976.

Demographics
As of the census of 2000, there were 6,634 people, 2,689 households, and 1,801 families residing in the county. The population density was 4/km² (12/mi²). There were 2,990 housing units at an average density of 2/km² (5/mi²). The racial makeup of the county was 97.75% White, 0.21% Black or African American, 0.44% Native American, 0.06% Asian, 0.02% Pacific Islander, 0.83% from other races, and 0.69% from two or more races. 1.66% of the population were Hispanic or Latino of any race. There were 2,689 households out of which 30.20% had children under the age of 18 living with them, 59.10% were married couples living together, 5.00% had a female householder with no husband present, and 33.00% were non-families. 30.20% of all households were made up of individuals and 16.30% had someone living alone who was 65 years of age or older. The average household size was 2.37 and the average family size was 2.95. In the county the population was spread out with 26.30% under the age of 18, 5.10% from 18 to 24, 24.00% from 25 to 44, 23.30% from 45 to 64, and 21.30% who were 65 years of age or older. The median age was 41 years. For every 100 females there were 93.50 males. For every 100 females age 18 and over, there were 91.30 males.

Bankruptcy law in Nebraska Fotolia.com Bankruptcy laws are federal, and cases are filed in U.S. District Courts; however, states amend certain areas of federal bankruptcy law . Nebraska bankruptcy law does not alter federal law significantly but does add provisions regarding income guidelines and secured versus unsecured debt. Chapter 7 and Chapter 13 bankruptcies are the most common form of individual bankruptcies in Nebraska, and Chapter 11 and 12 bankruptcies are typically reserved for corporations.
Chapter 7 Bankruptcies
  • In Chapter 7 bankruptcy, all assets are liquidated, and a person must discharge all unsecured property to creditors. Attorneys can provide guidance on what property is considered unsecured and what may be secured. Generally, a person's home is considered secured property, which cannot be handed over to creditors.
    Incomes must be below the median income for the State of Nebraska to be eligible for Chapter 7 bankruptcy.
