June 14, 1963. Before VOGEL, BLACKMUN and RIDGE, Circuit Judges. BLACKMUN, Circuit Judge. This declaratory judgment action is a controversy between two insurance companies. It concerns the legal significance of omnibus, employee exclusion, and severability of interests clauses in an automobile policy issued by Travelers. The district court granted Travelers' motion for summary judgment and dismissed Hanover's. The latter appeals. Judge Harper's opinion is now reported at 210 F.Supp. 765. The facts were stipulated. The parties also have conceded that their respective policies "were Missouri contracts and are to be construed according to the prevailing law in Missouri". Robert Fach was injured on December 23, 1959, when his hands were caught in a movable conveyor mechanism at the plant of Glazer Products Corporation in St. Louis. Fach at the time was an employee of Freight Express Company. He had driven his employer's truck to the Glazer plant for a load of freight. The mechanism used for loading the truck was suspended from the ceiling inside the building. It was owned by Glazer and was not an adjunct of Fach's truck. The physical loading of the truck had been completed. Fach sustained the injury as he helped push the mechanism back up into the Glazer plant. Fach sued Glazer in a Missouri state court. The action was based on negligence. The jury returned a verdict in favor of Fach. Judgment was entered and was paid and satisfied.

Term of Court The Court shall be in continuous session for the transaction of judicial business. Each calendar year shall be one term divided into three (3) parts, for purposes of Chapter 2313, O.R.C. Said parts shall be more particularly determined by Court order annually. RULE 2
Hours of Court Sessions The hours for holding the regular sessions of this Court shall be from 8:00 a.m. until 4:30 p.m. on Monday through Friday each week, except for those days designated by law as legal holidays. Said hours may be modified by the trial Judge to meet special conditions; hearings on motions, temporary restraining orders, or other matters of emergency will be held on Saturday mornings if requested and deemed necessary by the Court. RULE 3
Costs in Civil Matters On and after June 8, 2009, no civil actions or proceedings shall be accepted for filing by the Clerk unless the party or parties offering the same for filing shall have first paid court costs. Except as otherwise provided by law, when applicable, such costs shall be as follows: Complaint Filing (plus original service as set forth below) Each Defendant: Certified Mail Service Personal/Residential Service Express/Overnight Mail Service Ordinary Mail Service, Each Defendant

    In a 58-page unanimous opinion , the Supreme Court of Ohio has decided against eminent domain for purely economic benefit absent another public benefit.

    In the absence of other public benefit, the fact that an appropriation of property
    will provide an economic benefit to the community does not satisfy the
    public-use requirement of Section 19, Article I of the Ohio Constitution — The void-for-vagueness doctrine applies to statutes that regulate the use of eminent-domain powers — Courts shall apply heightened scrutiny when reviewing statutes that regulate the use of eminent-domain powers — The term “deteriorating area” as a standard for an appropriation of property is unconstitutional — R.C. 163.19 is unconstitutional in part.
