We welcome the opportunity to respond to the first phase of the Ofcom review of public service television broadcasting and we support the concept of an evidence-based approach to the framing of public policy. We also welcome the detailed factual and statistical information contained in the document Is Television Special? (ITS) and in its accompanying annex documents (made available on CD-ROM), in particular the sections on audience opinions and on viewing behaviour. 1.2. However, we are concerned that - in bringing forward its own propositions - Ofcom may have given too much weight to market expansion arguments and too little weight to public interest arguments.

Across the continent, its future is challenged by political and economic interests, by increasing competition from commercial media, by media concentrations and by financial difficulties. Some post-communist countries have not yet even started the transition from state-controlled to public electronic media. In other countries, public service broadcasting is in crisis. The report calls for a clear political commitment of European governments to maintain strong and vibrant independent public service broadcasting, whilst adapting it to the requirements of the digital age. I. Draft recommendation 1. Public service broadcasting is a vital element of democracy in Europe but it is under threat. It is challenged by political and economic interests, by increasing competition from commercial media, by media concentrations and by financial difficulties. It is also faced with the challenge of adapting to globalisation and the new technologies. 2. Public service broadcasting, whether run by public organisations or privately owned companies, is distinguished from broadcasting for purely commercial or political reasons by its specific remit, which is essentially to operate independently of economic and political power. It provides the whole of society with information, culture, education and entertainment, enhances social, political and cultural citizenship and stimulates the cohesion of society. To that end, it is typically universal in terms of content and access; it guarantees editorial independence and impartiality; it provides a benchmark of quality; it offers variety of programmes and services catering for the needs of all groups in society and it is publicly accountable. These principles apply whatever changes may have to be introduced to meet the requirements of the 21

    Public Service Broadcasting
    Public Service Broadcasters are broadcasters with a public service mandate. The definition of this mandate falls within the competence of the Member States, which can decide at national, regional or local level. Such a mandate would be consistent with the objective of fulfilling the democratic, social and cultural needs of a particular society and guaranteeing pluralism, including cultural and linguistic diversity. To fulfil this mandate, the public broadcaster benefits from license fees or direct financial support from the State. The Protocol on the System of public broadcasting in the Member States sets out the respective competencies of the European Union and the Member states in this field. The Commission's task is to verify whether or not Member States respect the Treaty provisions, especially the State Aid rules in this area. The Principles are laid down in the

INTRODUCTION National broadcasters funded out of the public purse have historically formed a vital component of the broadcasting sector in most countries and the rationale for these broadcasters – which can offer alternative programming to that provided by the commercial sector – remains strong. At the same time, two key issues continue to pose a threat to the success of publicly-funded broadcasters. The first is ongoing attempts in many countries by the governing authorities to exert control over such broadcasters, undermining their independence and the quality of their news and other programming. The other is the ever-present desire of governments to cut budgets, which has resulted in increased pressure on the level of public funding received by these broadcasters, and a consequent search for alternative sources of funding. This study looks at the way in which national, publicly-funded broadcasters are organised and paid for in six countries where support for these broadcasters remains strong, namely Australia, Canada, France, Japan, South Africa and the United Kingdom. The focus is on the legal and practical arrangements under which these broadcasters operate, including broadcasting obligations, governance structures and funding arrangements. The study pays particular attention to the ways in which these countries have dealt with the threats noted above, namely how they have guaranteed the editorial independence of these broadcasters, while at the same time ensuring their accountability to the public and providing them with public funds.
