Texas Overtime Labor Law August 16th, 2006 Posted by Mark The Texas overtime labor pay law has one interesting and unique facet that makes it worth its own look, I believe. Otherwise, however, the Texas law general leans on the federal law, as in, employers in Texas should look to the Fair Labor Standards Act for guidance on how to pay overtime to their employers. That’s not to say that we can’t also cover exactly what the Fair Labor Standards Act, or FLSA for short, says. For Texas employers, the most important thing to remember is that the federal law mandates that 40 hours be the typical length of the work week. If employees work more than those 40 hours in a seven-day period, then they should get overtime pay, according to the federal law. Overtime premium pay, under the federal law, as it is in many of the state laws that we’ve looked at as well, is one and a half times an employee’s normal pay rate. One of the important parts of the Fair Labor Standards Act and subsequent additions and revisions to the federal law is the exclusions, or the parts of the law that say who shouldn’t, or isn’t required, to be paid overtime. Texas employers should know, for instance, that under the federal law many salaried workers do not warrant overtime. Of course, the white collar and blue collar differentiation—with hourly workers getting overtime and salary workers not getting overtime—isn’t 100 percent accurate. But for the most part, any salaried worker that’s considered a “bona fide,” as the federal law says, administrator, executive or professional does not get overtime pay.
