The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 PRWORA Pub.L. 104-193 Stat. federal cash assistance to the poor. The bill was a cornerstone of the Republican Contract With America and was introduced by Rep. E. Clay Shaw, Jr. (R -FL-22) who believed welfare was partly responsible for bringing immigrants to the United States. Bill Clinton signed PRWORA into law on August 22, 1996, fulfilling his 1992 campaign promise to "end welfare as we know it". PRWORA instituted Temporary Assistance for Needy Families (TANF) which became effective July 1, 1997. TANF replaced Aid to Families with Dependent Children (AFDC) program which had been in effect since 1935 and also supplanted the Job Opportunities and Basic Skills Training (JOBS) program of 1988. The law was heralded as a "reassertion of America's work ethic" by the US Chamber of Commerce , largely in response to the bill's workfare component. Some

Section 484(a)(5) of the HEA recognizes as eligible for Title IV,
HEA assistance "a citizen or national of the United States, a permanent resident of the United States, able to provide evidence from the Immigration and Naturalization Service that he or she is in the United States for other than a temporary purpose with the intention of becoming a citizen or permanent resident." The Department has published annually in Appendix A to Chapter 2 of the Student Financial Aid Handbook the various INS statuses and documentation that qualify under the final "other than a temporary purpose" category. The bill makes significant reforms in child welfare by phasing in changes that include reauthorizing the Adoption Incentives Program and increasing the financial award allocated to states that have increased the number of children with special needs adopted from foster care through 2013 among other changes.
In unrelated adoption news, the Evan B. Donaldson Adoption Institute's report this month focuses on getting more families for foster children. (Source: Adam Pertman). The agency's report, "Expanding Resources for Waiting Children II: Eliminating Legal and Practice Barriers to Gay & Lesbian Adoption from Foster Care" offers specific, research-based recommendations to increase the pool of prospective adoptive parents for chidlren in foster care by changing state laws and agency practices so they become more welcoming of gay and lesbian applicants.

I In fact, during the first few years of welfare reform, the rolls fell so quickly that many state welfare agencies, which administer welfare for the federal government, stopped feeling pressure to move their remaining welfare clients back into the workforce. But since 2005, states have further reformed their welfare programs to comply with a controversial reauthorization of the 1996 legislation that required states to move even more people to work. This next, crucial phase of welfare reform could put an end to traditional cash welfare assistance in all but the most extreme cases. T T T M U nder the revised welfare rules, however, states can no longer ignore such employers and their jobs, and more states are reshaping their programs along work-first lines. Over the last two years, for instance, 17 states have created more stringent contracts for local private agencies working with welfare recipients, requiring them to meet job-placement targets or risk penalties. Arizona has told its contractors that if the federal government penalizes the state for failing to meet work goals, the contractors must share in the punishment. Private groups must even prove when bidding for Arizona contracts that they have sufficient financial reserves to pay any fines. But the state will also give bonuses to agencies that perform job placement well.

This paper presents an analysis of child welfare reform legislation as it has evolved from August, 1996 to August, 1997. It discusses why the legislation was passed in 1996, the purpose of the legislation, and the subsequent amendments to several sections that were enacted in 1997. Specific issues that are addressed in this paper relate to which salient reforms are most important to social work, which parts of the current legislation are too harsh/lenient to the affected population, and what moral issues can be extracted. A brief review of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (H.R. 3734), Public Law 104-193, follows. The new welfare law makes fundamental structural changes in the Aid to Families with Dependent Children (AFDC) program, as well as funding cuts in basic programs for low-income children , families, the elderly, people with disabilities and immigrants. According to the Congressional Budget Office, this law cuts funding for low-income programs by approximately $55 billion over the next six years. The Senate recently passed welfare reform legislation that would deny federal means-tested benefits, including welfare, Medicaid, food stamps, and veterans benefits, to individuals who are convicted of a state or federal crime related to drug use, possession or distribution. BACKGROUND: After President Clinton vetoed one version of welfare reform last year, Congress has been working to develop a proposal that he would sign. The House of Representatives passed a version of welfare reform (HR 3734) on July 18 which did not include any denial of benefits to people with drug related convictions; the Senate finished its work on HR 3734 on July 23. The amendment that was included in the Senate bill, offered by Senator Phil Gramm (R-TX), exempts family members and dependents of the convicted individual from denial of benefits to which they would otherwise be entitled. A conference committee has begun work to reconcile the differences between the two bills. I commend the House for acting quickly on bipartisan welfare reform legislation that builds upon our successful efforts that have moved millions of Americans from welfare to work. This compassionate approach will help many more Americans realize a better life of independence, hope, and dignity that comes with having a job. It will also promote strong families and healthy marriages, while freeing states to seek innovative ways to improve services to those who are transitioning from the welfare rolls to the workforce. I now urge the Senate to act without delay to strengthen our efforts to help our fellow Americans on welfare achieve independence through work.

September 17, 1996 Good morning Mr. Chairman and members of the Committee. As the Commissioner of the Administration on Children, Youth and Families in the Department of Health and Human Services, I am pleased to appear before you today to provide an overview of the Department's implementation of the new welfare reform legislationthe Personal Responsibility and Work Opportunity Reconciliation Act of 1996. The Administration for Children and Families is responsible for administering several of the programs most affected by this historic legislation, including: the new temporary assistance program for needy families; the child care programs for families on welfare and other low-income working families; and the child support enforcement program. In my testimony today, I will spend much of my time addressing implementation of the Temporary Assistance for Needy Families (TANF) program, as requested by the Committee. I would like to also briefly discuss the new child care provisions and will defer discussion of the child support enforcement provisions until Thursday when you will be devoting an entire hearing to that topic. Since the legislation was signed by the President only 26 days ago, I want to focus most on the process we have undertaken to facilitate implementation. Because of the bill's early effective dates and the extraordinary interest throughout the country in moving forward on welfare reform, officials at all levels of government are very busy. At the federal level, officials from the numerous departments affected by this legislation are working together to ensure coordinated assistance to the states.

1996 Welfare Amendments
The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (P.L. 104-193) began life as H.R. 3734 in the House of Representatives. This main purpose of this bill was to repeal Title IV of the Social Security Act of 1935, and the program then known as Aid to Families with Dependent Children (AFDC). This is the only program from the 1935 Social Security Act to ever have been repealed. Popularly, the bill was known as "welfare reform" legislation. The main reform introduced by the bill was the end to AFDC as a categorical entitlement and its replacement by a time-limited benefit program, tied to a work requirement. The new program is known as Temporary Aid to Needy Families (TANF). H.R. 3742 was one of several versions of the legislation that had been introduced in the House starting in early 1995. H.R. 3742 was the version that finally prevailed in the House, passing the House on July 18, 1996 by a vote of 256-120.

A Review of Mississippi's 1997 Welfare Reform Legislation

Introduction The Personal Responsibility and Work Opportunity Reconciliation Act of 1996, commonly known as the Federal Welfare Reform Act, mandated significant substantive changes in the operation of public assistance programs administered with federal funds throughout the states. From the states' standpoint, the most significant changes were:
  • termination of the permanent entitlement program (Aid to Families with Dependent Children [AFDC]) and initiation of a temporary assistance block grant program for working participants (Temporary Assistance to Needy Families [TANF]); and,
  • mandated strengthening of state laws dealing with collection of child support.
The Mississippi Governor's Office, in conjunction with the state Department of Human Services, submitted its first TANF state plan for 1996-1997 to the U. S. Department of Health and Human Services on September 30, 1996. This necessitated legislative action during the 1997 session to conform state law with federal TANF legislation so that the state could receive maximum benefit from the block grant program. The PEER Committee authorized the staff to analyze the state's plan for welfare reform, to assist the chairpersons of the Senate and House committees charged with handling subsequent welfare reform legislation, and to prepare a post-session report on welfare reform.
