Headlines: Microsoft expects to be sued over year 2000 compliance. In a recent SEC filing, Microsoft has stated that it believes that it is "likely" to be sued over year 2000 computer issues. (click here for full story- Boston Globe) Intuit sued again over non-compliance of Quicken. Intuit has been has been hit with its second lawsuit over the noncompliance of its popular Quicken software. This second suit was filed in New York state court and asserts that Intuit was negligent and should have known that its Quicken software, versions 6 and 7 would still be useful in the year 2000. Versions of this software were reportedly sold as recently as October of last year. A similar second suit was reportedly brought on April 29 in California.

    January 1999 Issue Y2K Law Offers Disclosure Protection By Fong Chan The Year 2000 Information and Readiness Disclosure Act, signed into law by President Clinton on October 19, limits the liability of any individual or organization that has issued or will issue any public statements or reports that deal with the Year 2000 problem. The AICPA advises that the act may provide CPAs with protection regarding publishing information on how to fix a Year 2000 problem and in situations where a client requests confirmation with Year 2000 process capabilities. Under the act, no Year 2000 statement clearly marked as a "Year 2000 Readiness Disclosure" can be used as evidence to prove the statement's accuracy or truth in a lawsuit against the individual or business issuing the disclosure. The law also allows organizations to cooperate with each other to seek a common solution to the problem without violation of antitrust laws. The act defines "Year 2000 statement" as any statement that a person or entity makes to another or to the public that deals with an assessment, projection, plan, timetable, testing, or operational problem or solution addressing the Year 2000 problem. The protection also applies to statements made or placed on a website and to documents containing a republication of another party's Year 2000 disclosure. The law does not apply to materials filed with the Securities and Exchange Commission and banking regulators, or information that accompanies the solicitation of an offer or sale of securities. In addition, it does not shield a business or individual who had actual knowledge that the statement was false, inaccurate, or misleading, or who acted in bad faith, with intent to deceive, or with reckless disregard as to the statement's accuracy. The protection also does not apply to any action brought by a consumer against a seller, manufacturer, or provider of a product with a Year 2000 statement expressly made in a solicitation (e.g., an advertisement or offer to sell, or a Year 2000 statement concerning a software program or service specifically designed to detect or correct a Year 2000 processing problem).

      New Y2K law encourages ADR use
      Dispute Resolution Journal Aug 1999
      President Clinton has signed a legislation that addresses possible litigation pertaining to computer problems anticipated with the approach of the year 2000. The new law includes provisions that encourage the use of alternative dispute resolution processes to resolve such disputes. The Year 2000 Readiness and Responsibility Act (H.R. 775) was signed into law by Clinton on July 20. U.S. Rep. Thomas M. Davis (R-Va.), who sponsored the Act, said the Act was meant to create an environment that promotes efforts to fix the so-called Y2K problems. The Y2K problem refers to an anticipated glitch in computer software programs that identify years using only two digits. These programs assume that years begin with "19" and will identify "00" as 1900 instead of 2000. The new Y2K law seeks to encourage businesses to focus on addressing, fixing, and testing their year 2000 problems, and to minimize any possible business disruptions associated with Y2K issues. The Act applies to any Y2K civil action in which a plaintiff's alleged harm or injury stems from a Y2K failure that occurs before Jan. 1, 2003, including any appeal, remand, stay, or other judicial, administrative, or alternative dispute resolution proceeding in such action. It is inapplicable to a claim for personal injury or wrongful death.

Colgate, Assistant Attorney General for Administration, U.S. Justice Department issued the following statement in response to Congressman Stephen Horn's assessment of the Department's Y2K readiness: "As the Department's Chief Information Officer and Y2K Program Manager, I can assure Congressman Horn and the American citizens that the Department of Justice will be fully ready to meet any Y2K law enforcement challenges. Federal agents will have access to the necessary tools to enforce our laws and there will be no interruptions in our law enforcement efforts due to computer malfunctions. "As Congressman Horn noted today, three of the Department's mission critical systems, one in the FBI, another in DEA, and a third in the Tax Division, have not been reported as Y2K compliant. All three are office-automation systems that provide basic word processing and administrative systems support and have been successfully deployed in individual offices at headquarters and in field offices. Each system has cleared Y2K testing and validation procedures, but until all the systems have been fully deployed to every office, the Department of Justice does not declare a system to be Y2K compliant. All three systems are expected to be fully deployed and implemented by mid-December. "In addition, there are contingency plans in place for all mission critical systems in Justice and each contingency plan has been verified and validated by an independent contractor.

    L et's see...when we left NASH world four months ago, the final shot was of Nash hovering over a sighing Caitlin in a kind of soft core porn segment which ended the season. So now Caitlin's moved in and changing Nash's apartment. Nash's apartment is kind of a ultimate bachelor pad complete with spectacular view, a hot tub on the roof (remember NASH fans?), pool table, pin ball machine, a cool freight elevator, and a big hole in the wall. Nash's place is like a department store with everybody coming and going as they please, including crazed stalkers and other criminal types. Wild commercials have been shot here (with goats and all), bachelorette parties with male strippers, and the apartment has even been assaulted by ninja assassins with wild shoot-outs, ending with the place being littered with dead bodies. Oh yes, then there's Old Man Nick. He's still got the hormones pumping, and probably getting his jollies listening to Nash and Caitlin have sex (there's a big hole in the wall, and who knows where there may be other smaller holes?) WHAT MATURE, SENSIBLE WOMAN WOULDN'T WANT TO LIVE HERE? It just needs a little redecorating, that's all. If it doesn't work out, she could moved into a frat house at UC Berkeley.

Log In Register Benefits September 27, 1999 Plan Now For Y2K Protection By Rivka Tadjer ompanies seeking protection from losses caused by year 2000 problems can buy themselves some protection by developing a new procurement policy, drafting new maintenance contracts, and checking to see if IT vendors will still be in business after the millennium arrives. In a revised procurement policy, make sure that all new site licenses and other technology purchases have an express Y2K warranty. Forget about simple 90-day warranties-even if you make the purchase after Oct. 1. It won't cover all your potential problems. For instance, you can now test an accounting software package by asking it to do projections after Jan. 1. But what about booting up after Jan 1? You won't know about that problem for more than 90 days. It gets tricky legally because an application software vendor can blame the operating system vendor if it doesn't boot up and then you're stuck in the middle. Assess risks and draft new maintenance contracts. This may involve a long session with your company attorney because you're covering two things. Second, create terms for purchasing new maintenance contracts that you will need with all your vendors. Once you've resigned yourself to knowing that you're going to shell out more bucks for new maintenance contracts, at least do it right this time. The provisions your contract should contain include express Y2K warranty and upgrades; limitation of liability; lost profits; business interruption; and property damage.

      The Right Thing to Do
      A Speech by Richard Turbin, TIPS Chair of the Tort and Insurance Practice Section, at the American Bar Association Annual Meeting (August, 1999). Here is my takeover speech - not with guns and violence but in the best ABA and TIPS tradition - using our advocacy skills to defend liberty and pursue justice. It is with great pride as well as with some trepidation that I accept the honor of serving as Chair of the Tort and Insurance Practice Section for the next year. Pride because I am truly honored to lead what I believe is the best lawyers organization in the world, but trepidation also because it is an awesome responsibility and I understand that I will have to work very hard and exercise considerable wisdom to prove equal to the task. Before we look towards where we want to go it would be prudent to look backwards from where we have come. By almost every standard of measurement TIPS finds itself strong and robust. Our member services are excellent, our publications peerless, our CLE exemplary. Our latest educational service, e-DICTA, was born and will mature on the Internet. TIPS tackles the most important national issue, gun violence, and introduces intelligence and wisdom into the dialogue. We can be proud of TIPS because it has not shrunk from the fight to preserve the civil justice system in America. We have testified in congress and provided the legal arguments to defeat the efforts to deprive Americans of their right to access their legal system when they are injured in automobile collisions. Likewise we did not shrink from our obligations to oppose the crusade to nationalize Y2K law and give partial legal immunity to the computer industry. Although one can argue that it would have been more prudent for TIPS not to have taken a stand on those controversial legal issues, it would not have been the right thing to do.
