    What is the "Rule of Law?" Our current Constitution states that public officers owe a duty to everyone in Zimbabwe to observe and uphold the rule of law [sec 18(1a)], and the "Kariba Draft" Constitution contains a similar provision.  However, most people - including lawyers - have only the vaguest idea of what the expression "rule of law" means. This is understandable because it is an elastic concept.  Fundamentally it means that people's rights and obligations must be determined by laws rather than by individuals or groups of individuals exercising an arbitrary discretion.  From this fundamental concept several principles are derived:
    • Principle of Legality : People must not be deprived of their rights or freedoms through the exercise of wide discretionary powers by the Executive. Rights and freedoms should be curtailed only by the ordinary courts applying the law.

    New Zimbabwe government must prioritize worsening humanitarian crisis: Oxfam
    Peter Mutoredzanwa Country Director for Oxfam in Zimbabwe 10 February 2009 The international aid agency, Oxfam, has cautiously welcomed steps in Zimbabwe to form a government of national unity, ending months of political deadlock. Oxfam calls on the new government to urgently address the rapidly deteriorating humanitarian situation inside the country, which is gripped by cholera and where more than half the population is in need of food aid. Hyperinflation and the dollarization of the economy has meant millions have been unable to access basic food staples, increasing the number of people needing food aid in both urban and rural areas. While several governments have said they will only restore substantial aid to Zimbabwe when there is concrete evidence of political and economic reform, Oxfam urges donors to explore innovative ways to channel emergency resources to people who urgently need help and for existing pledges of aid to be translated into funds on the ground. Oxfam supports calls for the creation of transparent mechanisms with clear benchmarks, supported by regional bodies like the African Union (AU) and Southern African Development Community (SADC), to monitor the implementation of the power-sharing agreement and policies of the new government.

    PRINCIPAL GOVERNMENT OFFICIALS Chief of State: President Robert Gabriel Mugabe Head of Government: Prime Minister Morgan Tsvangirai The Zimbabwean constitution institutionalizes majority rule and protection of minority rights. The elected government controls senior appointments in the public service, including the military and police, and the independent Public Service Commission is charged with making appointments at lower levels on an equitable basis. The judiciary is headed by the chief justice of the Supreme Court who, like the other justices, is appointed by the president on the advice of the Judicial Service Commission. The constitution has a bill of rights containing extensive protection of human rights. The bill of rights could not be amended for the first 10 years of independence except by unanimous vote of the parliament. Zimbabwe is divided into ten provinces, each administered by a provincial governor appointed by the president. The provincial administrator and representatives of several service ministries assist the provincial governor.

    MEDICAL RESEARCH COUNCIL OF ZIMBABWE
    Establishment The Medical Research Council of Zimbabwe, which is the National Ethics Committee (NEC) was established in 1974 in terms of the Research Act of 1959 and Government Notice Number 225 of 1974 in order to provide health researchers and institutions which/in which health research is conducted, with independent ethical advice on research conducted by those researchers or by/within those institutions. The MRCZ is established and supported by the Government of Zimbabwe through the Ministry of Health and Child Welfare. The MRCZ is composed of scientists, medical experts, ethicists, patient representatives, and community representatives. It is independent in its reflection, advice, and decision. The MRCZ depends on annual grant from the Ministry of Health and Child Welfare as well as donations from well-wishers. The MRCZ also raises income through other means such as charging for services rendered. Donations in any form are most welcome. Objectives The MRCZ is established in order to among other functions, provide independent guidance, advice, and decision on biomedical research conducted/carried out within Zimbabwe by all researchers and institutions, as well as ethical advice on issues presented to it by the Institutional Ethical Committees that exist within the various health institutions in Zimbabwe. The MRCZ's functions are similar to those of an institutional review board (in USA). The Medical Research Council of Zimbabwe undertakes the following specific tasks:

    According to Zimbabwe's Constitution, the president is head of state and ahead of government elected for a 6-year term by popular majority vote. Parliament consists of the House of Assembly and has up to a 5-year life span. The House of Assembly has 120 members elected by the common-roll electorate, eight governors, 10 chiefs, 12 presidential appointees, the Speaker, and the Attorney General. The Zimbabwean Constitution institutionalizes majority rule and protection of minority rights. The elected government controls senior appointments in the public service, including the military and police, and insures that appointments at lower levels are made on an equitable basis by the independent Public Service Commission. The provincial governor is assisted by the provincial administrator and representatives of several service ministries. Zimbabwe is governed by President Robert Mugabe and his Zimbabwean African National UnionPatriotic Front (ZANU-PF), which has controlled the legislative and administrator branches since freedom in 1980.
