    Cell Tracking
    Can the government use your cell phone records to track your physical location without first obtaining a warrant based on probable cause? Often with EFF input as a friend of the court, the vast majority of judges issuing public opinions on the matter are saying “no”, and rejecting government applications for cell site location tracking information made without showing sufficient need for this kind of sensitive information. This issue came to light in August 2005, when the first judge to publish a decision on the issue—Magistrate Judge Orenstein in the Eastern District of New York—publicly denied a government request that lacked proof of probable cause. In doing so, Judge Orenstein revealed that the Justice Department had routinely been using a baseless legal argument to get secret authorizations from a number of courts, probably for many years. Many more public denials followed from other judges, sharply rebuking the government and characterizing its legal argument as as "contrived," "unsupported," "misleading," "perverse," and even a "Hail Mary" play. But the government continues to rely on the same argument in front of other judges, most often in secret and sometimes successfully. EFF has been asked to serve as a friend of the court in several of these applications, successfully showing judges how and why the government's arguments are baseless. EFF will continue to serve as a resource to courts and to counsel, to protect your privacy interest in your physical location, to stop the government from turning the cellular phone system into a vast network for warrantless physical surveillance and to ensure that Big Brother stays out of your pocket.

    US v. ElcomSoft Sklyarov
    View U.S. v. ElcomSoft Sklyarov frequently asked questions Dmitry Sklyarov, the 27 year old Russian programmer at the center of this case, was released from U. S. custody and allowed to return to his home in Russia on December 13, 2001. The Frequently Asked Questions (and Answers) which follow this text were prepared by the EFF at the time of Dmitry's arrest in July 2001 and have been updated to take account of subsequent developments. For those familiar with the previous version of the FAQs, the following paragraphs summarize the history of this case and developments since August 2001. On August 28, 2001, a grand jury indicted both Dmitry and ElcomSoft with five counts of violating U.S. law. These include four counts alleging circumvention offenses and aiding and abetting circumvention offenses, under the DMCA, and a charge of conspiracy to traffic in a circumvention program. Under the charges, Dmitry faced up to 25 years in prison and a fine of up to $2,250,000, and ElcomSoft, as a corporation, faces a penalty of $2,500,000. (For further details, see the next question.) On December 13, 2001, Dmitry was released from U.S. custody and allowed to return to his home in Russia, as part of an agreement between Dmitry and the U.S. Attorney on behalf of the U.S. government. Under the agreement, all the criminal charges against Dmitry will eventually be dropped. The agreement requires Dmitry to testify for the U.S. Government in its continuing case against Dmitry's employer, ElcomSoft. It is likely that Dmitry will also testify on behalf of ElcomSoft.

Updated Feb 11 2009 Whether you're a newly minted blogger or a relative old-timer, you've been seeing more and more stories pop up every day about bloggers getting in trouble for what they post. The difference between you and the reporter at your local newspaper is that in many cases, you may not have the benefit of training or resources to help you determine whether what you're doing is legal. And on top of that, sometimes knowing the law doesn't help - in many cases it was written for traditional journalists, and the courts haven't yet decided how it applies to bloggers. But here's the important part: None of this should stop you from blogging. Freedom of speech is the foundation of a functioning democracy, and Internet bullies shouldn't use the law to stifle legitimate free expression. That's why EFF created this guide, compiling a number of FAQs designed to help you understand your rights and, if necessary, defend your freedom.
