Introduction The commercialization of the Internet has dramatically increased the importance and economic value of domain names. The sets of alphanumeric characters denoting Internet addresses have become a major source of cash, controversy, and case law. Catchy “dot-com” phrases are splashed across billboards, buses, and Superbowl advertisements. Companies and individuals struggle over the more attractive and memorable of the names, resorting to the courts, alternative dispute resolution mechanisms, and the private market to settle their disputes. In late 1999, for example, the peak of the dot-com hype, eCompanies reportedly paid $7.5 million for the rights to the " business.com " tag the highest price ever to be paid for a domain name. Trademark law has proven to be an awkward device for resolving conflicts over domain names. For example, traditional trademark law allows two non-competing entities to utilize the same mark, as long as there is no likelihood of consumer confusion.

    WIPO LAUNCHES PAPERLESS UDRP PROCEEDINGS Decision-making authority under the Uniform Domain Name Dispute Resolution Policy and Rules (UDRP) lies exclusively with the appointed panels. To assist awareness of their views on certain questions that commonly arise in proceedings under the UDRP, the WIPO Arbitration and Mediation Center has produced the following informal overview of panel positions on key procedural and substantial issues. Decision references supporting each line of opinion are included, with over 100 decisions from over 80 different UDRP panelists listed. Broad information on all views is available from the http://www.wipo.int/amc/en/domains/search/ ), as well as from the full posting of all decisions ( http://www.wipo.int/amc/en/domains/decisions.html This overview is created in recognition of the need that has been expressed to identify, as much as possible, consensus among UDRP decisions, so as to maximize the consistency of the UDRP system. The result was the nonprofit Internet Corporation for Assigned Names and Numbers ( ICANN ) that includes advisory bodies which develop and recommend policies, such as the Domain Name Supporting Organisation. The UDRP came about as an alternative to litigation for resolving disputes between trademark owners and domain name registrants. It was decided that a uniform dispute resolution policy should be adopted, to prevent disputants being subjected to differing process and policy issues depending on where the domain name was registered. 4.
