Environmental Laws 101
What factors of mother nature does environmental law deal with on a daily basis? A few categories it keeps in check are that of air quality, water quality, global climate changes, agriculture, pesticides, species preservation, waste management and hazardous chemical storage, treatment and management. Research to improve our nations environmental law is on going and laws are changing or being added on a daily basis, as it is seen fit to do so.  Some new laws go into effect as a means of experimentation to see how they not only affect the earth and environment, but also the general population who has to abide by the new law. These experimental laws are usually outside the bounds of traditional command and control regulations. A good citizen with good concience does not need many environmental laws in place to tell them what they can and cannot do or what they should or should not to protect mother earth. Many environmental laws are common sense. Most people would know not to dump toxic waste into our drinking water or oceans, but there are people out there in the world today, who because of greed and money do not care about our earth or what happens to it. There are also a select few who choose to recycle certain commonly used products such as aluminum cans, plastic bottles and recyclable packing peanuts . On the other hand, you have people who are the exact opposite and could care less about the mess the make and the trash they create. This is the exact reason we have environmental firms who run staffs of environmental lawyers to prosocute those destroying the earth.

RECENT TRENDS International shipping... Greenhouse gas and the world economic slowdown made for interesting trends revealed from the recent International Transport Forum, where discussion of maritime shipping noted that less shipping means reduced greenhouse gas from fuel use and scraping of less efficient vessels. As world trade shifts in response to the economic crisis: China has gone from net exporter to importer of coal, but may revert back to exporting. Commodity downturns mean less shipping. Product liability... litigation moving to California from Texas was a widely noticed phenomenon. But the trend never lasted. When Texas instituted tort reforms, its "wildcatting" plaintiffs firms looked to California for claims for asbestos injury and other "mass tort" actions. But during the last few years those firms have turned their attention to other states. BLOGS Smith on California Property Smith on

      Environmental Law Programming
Harvard Law School’s Environmental Law Program continues its impressive expansion this year. Under the direction of Professor Jody Freeman, the Program is in the midst of an exciting year marked by developments on several fronts.  The Environmental Law Program is please to announce several updates for the 2009-2010 academic year: A diverse array of environmental law courses for 2009-2010. In addition to the foundational Environmental Law course, Visiting Professor Michael Vandenbergh from Vanderbilt University Law School will also teach Climate Change in the Fall.  Visiting Professor Richard Lazarus from Georgetown University Law Center  will teach Environmental Law in Theory and Application in Winter Term.  Clinical Director and Clinical Professor Wendy Jacobs will teach HLS' seminar on Environmental Law Practice: Skills, Methods and Controversies in the Spring. Visiting Professor Jedidah Purdy will teach Natural Resources Law and Policy and the seminar Sources of Environmental Law.  (See Descriptions of 2009-2010 Courses More broadly, we are in the midst of designing a comprehensive curriculum that will provide each HLS student an opportunity to engage with environmental issues. The Program will offer a wide selection of environmental law courses over every three-year period: students with little background in environmental law will have opportunities to be introduced to the field, and those with a dedicated interest will have opportunities to pursue advanced work. The new curriculum will guarantee students access to core courses like Environmental Law, Natural Resources Law, International Environmental Law, Climate Law, and Energy Law. Through these courses and other academic activities, the Program will prepare students for careers in environmental law and introduce those with plans in other fields to an area of cross-cutting interest. The program also supports environmental law scholarship by providing students access to a variety of faculty working on projects in the field.
