Hazardous Waste (Regulation of Exports and Imports) Act 1989
The main purpose of the Hazardous Waste (Regulation of Exports and Imports) Act 1989 ('the Act') is to regulate the export and import of hazardous waste to ensure that hazardous waste is disposed of safely so that human beings and the environment, both within and outside Australia, are protected from the harmful effects of the waste.
What we do
The Department of the Environment, Water, Heritage and the Arts administers and implements the Act. The Act was developed to enable Australia to comply with specific obligations under the Basel Convention on the Control of the Transboundary Movements of Hazardous Wastes and their disposal, a Convention set up to control the international movements of hazardous wastes. The main functions performed by the Department in relation to hazardous waste include:

    Hazardous Waste Regulatory Program
    The Wisconsin Department of Natural Resources operates a federally authorized hazardous waste regulatory program. Staff in this program help to ensure the protection of Wisconsin's ground and surface water, air and soil by working with waste generators and facilities to encourage the proper management of hazardous wastes. In Wisconsin, there are over 11,000 businesses, schools and government institutions that generate varying quantities of hazardous wastes each year. The number of hazardous waste generators and the quantity of hazardous waste that they generate is declining each year as everyone learns how much it costs to generate wastes and manage hazardous wastes according to the strict requirements that apply. While much of the solvent-type hazardous wastes that are generated in Wisconsin are recycled here, many other hazardous wastes are handled out of state. Wisconsin also is home to 17 licensed hazardous waste management facilities. Many of these facilities are privately operated, serving the needs of that particular facility's hazardous wastes. The commercial hazardous waste facilities in Wisconsin primarily focus on recycling of hazardous waste solvents and mercury, fuel blending of hazardous wastes for energy recovery, storage of hazardous wastes prior to the treatment at licensed hazardous waste facilities in other states and treatment of hazardous wastes to facilitate disposal. There are no operating hazardous waste disposal facilities (i.e., landfills) in Wisconsin.

Powered by WP Greet Box WordPress Plugin As mentioned last week, we won a rare non-suit motion in the  Ontario Court of Justice on three counts, each against three defendants charged with improperly managing hazardous waste at a transfer site, contrary to the  Environmental Protection Act . In each case, the Ministry of the Environment inspector had accused the company of committing offences, without properly investigating whether this was true. Eight other charges proceeded to trial, on the grounds that the Crown had raised some evidence, no matter how manifestly unreliable, which should be weighed at the end of the trial. We hope to finish this very long trial next month, and look forward to reporting on the result. Tagged as: 2.5 cm

  • Hazardous Waste Regulation
    This section is responsible for the management of the statewide Hazardous Waste program which includes interaction with EPA, district offices and other department programs pertaining to Hazardous Waste compliance, enforcement and permitting. The section is also responsible for the implementation of the federally delegated Resource Conservation and Recovery Act (RCRA) program, which issues permits for hazardous waste treatment, storage, and land disposal facilities. Technical assistance and training are provided to the district offices and the regulated community. Solid Waste Management
    This section is responsible for implementing the state's solid waste management program. It administers the Financial Assurance Program and Full Cost Accounting for solid waste facilities. Technical assistance is provided to the district offices concerning the permitting, compliance and enforcement activities associated with solid waste facilities. Waste Reduction
    This section is responsible for several waste management program areas: state-wide recycling and waste reduction, household hazardous waste, mercury lamps and devices, batteries, unwanted medications, electronics scrap, and certain pesticides through Operation Cleansweep. Grants are also provided to local governments for the implementation of solid waste management, innovative recycling programs and household hazardous waste collection centers.

Superfund
Since Congress enacted the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) in December 1980, corrective action has been taken at thousands of contaminated sites across the country. However, nearly 30 years of federal attention to cleaning up contaminated sites has done little to reduce the problem. As of November 2008, 1,255 sites were listed on the National Priorities List (NPL), down only slightly from 1,273 sites in 2004, and another 9,957 sites were awaiting evaluation for possible listing. While the number of sites remains relatively constant, federal funding during the last 20 years has systematically decreased. When it was enacted, CERCLA established the Superfund Trust Fund, which was funded by a corporate environmental income tax and excise taxes on petroleum and specified chemicals. The trust fund received approximately $1.5 billion per year before the legislative authority authorized to collect the taxes expired on December 31, 1995. While there has been some interest in reinstating the taxes, there has been little legislative action. Superfund cleanup is currently funded through the ongoing appropriations process.
