He holds a doctoral degree in law of the University of Graz (1996). His current research interests are in international human rights law, the law of international organisations, the law of armed conflict, and human security. He attended the Academy of European Law at the European University Institute in Florence in 1997 and, from 1998 to 1999, served as Legal Adviser in the Department for Human Rights, Minority Rights and International Humanitarian Law of the Office of the Legal Adviser, Austrian Federal Ministry for Foreign Affairs. [The Human Rights Library wishes to express its gratitude to the Institute Henry Dunant for its contribution of this document.] PREFACE War holds a great place in history, and it is not to be supposed that men will soon give it up in spite of the protests which it arouses and the horror which it inspires because it appears to be the only possible issue of disputes which threaten the existence of States, their liberty, their vital interests. But the gradual improvement in customs should be reflected in the method of conducting war. It is worthy of civilized nations to seek, as has been well said (Baron Jomini), "to restrain the destructive force of war, while recognizing its inexorable necessities". The Institute, too, does not propose an international treaty, which might perhaps be premature or at least very difficult to obtain; but, being bound by its by-laws to work, among other things, for the observation of the laws of war, it believes it is fulfilling a duty in offering to the governments a ' Manual ' suitable as the basis for national legislation in each State, and in accord with both the progress of juridical science and the needs of civilized armies. Rash and extreme rules will not, furthermore, be found therein. The Institute has not sought innovations in drawing up the ' Manual '; it has contented itself with stating clearly and codifying the accepted ideas of our age so far as this has appeared allowable and practicable. By so doing, it believes it is rendering a service to military men themselves. In fact so long as the demands of opinion remain indeterminate, belligerents are exposed to painful uncertainty and to endless accusations. A positive set of rules, on the contrary, if they are judicious, serves the interests of belligerents and is far from hindering them, since by preventing the unchaining of passion and savage instincts which battle always awakens, as much as it awakens courage and manly virtues, it strengthens the discipline which is the strength of armies; it also ennobles their patriotic mission in the eyes of the soldiers by keeping them within the limits of respect due to the rights of humanity.

5.1.1. International Regulation on River Navigation - Resolution of Heidelberg, 9 September 1887
General Provisions Article 1 The riparian States of a navigable river are obliged, in the general interest, to regulate, by common agreement, everything relating to the navigation of such river. Article 2 Article 3 The navigation on the whole course of international rivers, from the point where each of them becomes navigable, to the sea, is entirely free, and cannot, as regards commerce, be forbidden to any flags. The boundary line of the States separated by the river is marked by the thalweg, that is to say, by the middle line of the channel. Article 4 The subjects and flags of all nations are in every respect on the footing of perfect equality. No distinction shall be made between the subjects of riparian States and those of non-riparian States. Article 5 The navigation dues levied on international rivers shall have, for their exclusive object, that of covering the cost of the works for the improvement of these rivers and of the maintenance of their navigability in general. Article 6 In time of war, the navigation of international rivers shall be free for the flags of neutral nations, subject to such restrictions as may be imposed by the force of circumstances.

    How to find us?
    The Institute
    (1904-1984), a former Professor of International Law at the University of Helsinki and a former member of the International Law Commission. The aim of the Institute is to promote research on human rights and new approaches in public international law. In the course of its years of activities the Erik Castrén Institute has completed several projects of consultant research, many of which have been commissioned by the Finnish Ministry of Foreign Affairs. There are currently several on-going research projects commissioned from the Institute. Studies have been published about each completed project in the Forum Iuris-publishing series of the Faculty of Law and the Erik Castren Institute's own Research Reports series. In addition, another series, The Erik Castrén Institute Studies in International Law, was launched in the year 2000. Among other seminars, the Institute organizes an annual two-week "Helsinki Summer Seminar" on contemporary international law in conjunction with the Faculty of Law at the University of Helsinki. Speakers are of high international standard and participants come from all over the world.
