Driver Fatigue, Driving Safety, and Forensic Human Factors Analysis for Accident Reconstruction
Driver fatigue is a significant cause of traffic accidents. In truck and bus accident litigation, claims based on driver fatigue are being made in increasing numbers. Defense and plaintiff's attorneys who deal with fatigue claims should consult a forensic driver fatigue expert. The forensic expert should be competent in: the nature and relative importance of the various causes of driver fatigue , and the specific effects of fatigue on driver performance; the human factors engineering and scientific aspects of driving safety , including driver skill and knowledge requirements for the various classes of vehicles, the basis of the Commercial Driver License (CDL) system, and the safety responsibilities of truck and bus drivers and motor carriers; forensic human factors analysis for accident reconstruction. Notices and Final Rules
Notices and Final Rules Issued by NHTSA
ABOUT THIS PAGE As of April 7, 1997, NHTSA expanded its posting of rulemaking documents on its web page. We are now posting all notices of proposed rulemaking and final rules that are considered to be "significant" by the office of Management and Budget. To the extent possible, we will also post other notices and rules, but resources do not yet permit us to post all of them. The documents will be posted at the same time they go on public display at the Federal Register. For example, on April 7 we posted the final rule responding to petitions for reconsideration on Federal Motor Vehicle Safety Standard No. 201, Occupant Protection in Interior Impact . The Federal Register made this rule public on April 7, 1997, and published it on April 8, 1997.
Occupant Protection
Federal Motor Vehicle Safety Standards; Occupant Crash Protection (Final Rule) -posted 12/08/2004
This document adopts NHTSA’s proposal to require all designated seating positions in rear seats, other than side-facing seats, be equipped with Type 2 integral lap/shoulder safety belts. Side-facing seats may be equipped with either a Type 1 lap belt or a Type 2 belt. This final rule responds to a Congressional mandate that the agency begin to phase-in requirements for lap/shoulder belts for all rear seating positions, wherever practicable, not later than September 1, 2005.
